Delhi HC Denies Bail to Former AAP MLA Naresh Balyan in MCOCA Case

The Delhi High Court on Monday dismissed the bail plea of former Aam Aadmi Party (AAP) MLA Naresh Balyan in a case registered under the stringent Maharashtra Control of Organised Crime Act (MCOCA).

A single-judge Bench of Justice Manoj Jain rejected Balyan’s plea after reserving the order last week. The former Uttam Nagar legislator had challenged a trial court decision denying him bail in the organised crime case filed by the Delhi Police Crime Branch.

Balyan was arrested again in December 2024 under MCOCA, shortly after he received bail in a separate extortion case. Police took him into custody from the court premises following the relief granted by the Rouse Avenue Court in the earlier matter.

The former MLA was initially arrested on November 30, 2024, after alleged audio recordings surfaced purportedly involving a conversation between him and gangster Kapil Sangwan alias Nandu. Police claimed the recordings indicated discussions related to threats and extortion demands targeting builders and other individuals in Delhi.

According to the Delhi Police, Balyan was allegedly linked to a wider criminal syndicate operating in Delhi and neighbouring areas, involved in activities including extortion and arms trafficking. The police charge sheet described the group as an organised network involved in illegal activities for financial gain.

The supplementary charge sheet names four accused — Vijay alias Kalu, Sahil alias Poli, Naresh Balyan and Jyoti Prakash alias Baba.

The Delhi Police had opposed Balyan’s bail plea, arguing that the investigation was at a sensitive stage and his release could affect the probe. Balyan has denied the allegations, claiming that the case against him was politically motivated and based on fabricated accusations.

In a separate development, a Delhi court on July 31 discharged Balyan in an extortion-related case registered at Mohan Garden police station. The court held that the prosecution failed to establish sufficient grounds for framing charges under relevant sections of the Indian Penal Code, including criminal conspiracy and extortion-related provisions.
