The Delhi High Court has expanded the scope of its earlier interim order in a defamation suit filed by the Isha Foundation, directing the removal of an additional 39 short videos and five English-language videos allegedly containing defamatory content against spiritual leader Sadhguru Jaggi Vasudev.
Justice Subramonium Prasad passed the order while allowing an application filed by the Isha Foundation seeking clarification of the court’s interim injunction dated March 19. The Foundation argued that although the earlier order covered certain videos and articles, it did not specifically include the additional videos listed in Paragraph 10 of the plaint despite allegedly containing similar content.
The respondents opposed the application, contending that it effectively sought a review of the earlier order under the guise of a clarification and attempted to expand the scope of the interim relief.
The High Court, however, observed that while the application was styled as one seeking clarification, it was essentially a request for modification. Justice Prasad held that the relief sought was within the scope of the earlier injunction because the contents of the plaint had already been incorporated into the original interim application.
The court noted that its March 19 order had already found the impugned content to be prima facie defamatory and had referred to Paragraph 25 of the injunction application, which in turn incorporated Paragraph 10 of the plaint. As such, the additional 39 short videos and five English-language videos did not require separate adjudication.
Modifying its earlier directions, the High Court restrained the concerned defendants from creating, publishing or disseminating defamatory content and directed the removal of the additional videos along with the previously identified material.
The court ordered that the latest directions be read together with its March 19 order and disposed of the application. The matter is now scheduled to be heard by the roster Bench on August 5.
The Isha Foundation had filed the suit alleging that defamatory and misleading videos targeting Sadhguru continued to circulate on online platforms despite earlier legal proceedings.
