Tejashwi Yadav seeks NHRC probe into 19-year-old’s death in Madhubani jail

Rashtriya Janata Dal (RJD) leader and Bihar Leader of Opposition Tejashwi Yadav has approached the National Human Rights Commission (NHRC) seeking intervention into the death of 19-year-old Roshan Yadav, who died while in judicial custody at Mandal Karagar, Rampatti, in Madhubani district.

In a letter dated August 22 to the NHRC Chairperson, Tejashwi sought an independent examination of the circumstances surrounding Roshan’s death and action against officials found responsible.

Roshan had been in judicial custody since May 27 and was found dead inside the jail on August 10. According to the letter, jail authorities reported that he had died by hanging. His family, however, has disputed the account and alleged that there were multiple injury marks on his body.

The family has also alleged that no written information about Roshan’s arrest was provided to his next of kin.

Tejashwi, in a post on X, alleged that Roshan was “brutally murdered by the police while in police custody”. He said he had approached the Human Rights Commission seeking justice for the deceased and stringent action against officials found guilty.

“A letter was written to the Human Rights Commission demanding justice for the victim and stringent action against the guilty officials,” he said, adding that the issue would be raised on every platform to ensure justice.

The RJD leader’s letter said the Madhubani administration had indicated that a magisterial inquiry would be conducted in accordance with NHRC guidelines and that a report would be submitted.

Tejashwi requested the NHRC to take cognisance of the matter and seek reports from the Bihar Director General of Police and Director General of Prisons.

He also urged the Commission to verify compliance with its custodial death guidelines, including the availability of CCTV footage from two police stations covering the period from Roshan’s arrest until his death, mandatory medical examinations, intimation to his family and videography of the post-mortem.

The letter further sought directions for submission of the post-mortem, inquest and magisterial inquiry reports to the NHRC within a stipulated timeframe. It also requested that Roshan’s family be kept informed about the proceedings and provided appropriate relief as deemed necessary by the Commission.

According to the letter, Roshan belonged to a low-income family headed by his widowed mother and had two sisters.

The case has triggered political attention in Bihar, with Tejashwi accusing the state government and bureaucracy of failing to protect citizens and vowing to pursue the matter across platforms.
