AIMIM president Asaduddin Owaisi has criticised the Allahabad High Court’s dismissal of a Muslim student’s plea seeking permission to wear a hijab with her prescribed school uniform, calling the decision an “attack on Islam” and questioning the court’s approach to determining essential religious practices.
Addressing a gathering at the AIMIM headquarters in Darussalam, Owaisi said he disagreed with the verdict and argued that it violated the constitutional protections of religious freedom and freedom of expression.
“I disagree with this High Court judgment; I do not concur with it… Today’s verdict violates Articles 25 and 19 of the Indian Constitution. Who are you to decide what is essential to Islam? Girls are wearing hijab on their heads, not on their minds. It is an attack on Islam,” he said.
The Allahabad High Court had dismissed the petition filed by a minor student from a private CBSE-affiliated school in Prayagraj. A division bench of Justices J.J. Munir and Indrajeet Shukla held that the student had not produced sufficient material to establish that wearing a headscarf was an essential religious practice. The court also held that a school can enforce a uniform dress code when it is uniform, bona fide, non-discriminatory and intended to maintain discipline and institutional identity.
Owaisi also targeted the RSS and BJP over the ongoing political debate surrounding the Manusmriti. He alleged that sections associated with the RSS had historically opposed the Constitution and favoured the Manusmriti, referring to criticism published in an RSS mouthpiece shortly after the Constitution was adopted.
He also criticised Hindutva ideologue V.D. Savarkar over his conduct during imprisonment in the Andaman Cellular Jail and contrasted it with the sacrifices of Muslim freedom fighters.
On the Uniform Civil Code, Owaisi questioned whether laws drawing from existing personal-law frameworks could be described as genuinely uniform. He also criticised the implementation of the UCC in Uttarakhand, Assam and Gujarat, arguing that Muslims should not be subjected to provisions rooted in Hindu personal laws.
Owaisi further said attempts to distance Muslims from their religious beliefs would not succeed and reaffirmed that the community would remain committed to the Quran and Sunnah.
He also stressed that Muslims love and would protect India, saying they would continue contributing to the country’s development while remaining committed to their faith.
