FSSAI notices prompt food companies to withdraw misleading claims, change packaging

Several food business operators have withdrawn misleading claims, advertisements and product listings or revised their packaging after receiving notices from the Food Safety and Standards Authority of India (FSSAI), the regulator said on Tuesday.

The action follows FSSAI scrutiny of health, nutrition, trade and other product claims that could potentially mislead consumers. The authority said major food businesses responded promptly to its notices and took corrective measures to comply with food safety regulations.

In one case, Mondelez India Foods Private Limited was found to have made misleading health and comparative nutrient claims. Following the FSSAI notice, the company withdrew the claims and related advertisements from e-commerce platforms and initiated compliance measures.

Sapiens Labs was also issued a notice over a misleading claim. The company submitted its response to FSSAI and withdrew all claims and advertisements associated with the product concerned.

In another case, products marketed by Vichlagro Products Pvt Ltd and processed and packed by Mrs Janki Jay Barot/JJ Foods were found to carry a misleading trade name. Following FSSAI intervention and a response from Flipkart, the concerned food business operator delisted the product from the platform.

FSSAI also flagged the use of the term “100 per cent” by Amway India Enterprises Pvt Ltd, Delhi, in the product name “100 per cent Pure Coconut Oil”.

The regulator said the usage was contrary to provisions of the Food Safety and Standards Act, 2006, the Food Safety and Standards (Advertising and Claims) Regulations, 2018, and its advisory on discontinuing the use of “100 per cent” on food product labels and promotional material.

Following the notice, Amway India submitted a compliance response confirming that it had voluntarily removed the term from its product packaging and promotional material. The company also stated that old stock had been discontinued from sales channels.

FSSAI said such corrective measures are aimed at ensuring that food labels and promotional material remain compliant and do not mislead consumers.
