The Kerala High Court on Wednesday granted temporary relief to a school teacher who was suspended over a quiz question describing V.D. Savarkar as a freedom fighter who received the most severe punishment from the British.
Justice Viju Abraham, hearing a petition filed by teacher K. Guruprasad Rai, stayed the operation of the suspension order for one month. However, the court made it clear that the disciplinary proceedings against Rai could continue.
“I’m inclined to pass an interim order staying the operation of the suspension order for a period of one month. But I am permitting the disciplinary proceedings to continue,” the court said.
The case arose from a quiz question prepared by Rai that identified Savarkar as a freedom fighter who had received the most severe punishment from the British. The question subsequently led to action against the teacher and ultimately his suspension.
Rai challenged the suspension before the High Court and sought interim relief during the pendency of the proceedings.
While granting the temporary stay, the court did not interfere with the disciplinary process. The authorities have been permitted to continue proceedings against the teacher independently of the interim protection granted to him.
The matter has drawn attention to the treatment of historically and politically contested personalities in educational material and the discretion available to teachers while preparing academic content.
For now, the suspension will remain stayed for one month. The disciplinary proceedings, however, will continue, leaving the substantive dispute over the quiz question and the action taken against Rai open for further adjudication.
