The Bombay High Court has issued a notice to the Enforcement Directorate (ED) after actor and businessman Raj Kundra challenged a Special Prevention of Money Laundering Act (PMLA) Court order taking cognisance of a supplementary prosecution complaint against him in the alleged ₹185-crore bitcoin case.
Kundra, husband of actress Shilpa Shetty, has filed a writ petition challenging the Special PMLA Court’s order dated January 5, 2026, by which cognisance was taken of the ED’s supplementary complaint.
In his petition, Kundra has contended that the Special Court failed to comply with the mandatory requirements under Section 223(1) of the Bharatiya Nagarik Suraksha Sanhita (BNSS), rendering the order legally unsustainable. He has sought quashing of the cognisance order along with consequential reliefs.
The supplementary prosecution complaint against Kundra was filed by the ED in September 2025.
According to the Enforcement Directorate, Kundra allegedly received 285 Bitcoins linked to the proceeds of crime for establishing a bitcoin mining project in Ukraine that ultimately failed. The agency has alleged that he was unable to account for the cryptocurrency or disclose the details of the digital wallet in which the assets were allegedly held.
The writ petition was argued before the High Court by advocate Prashant Patil and came up for hearing before Justice Ashwin Bhobe.
After considering the petition, the High Court admitted the matter and issued notice to the Enforcement Directorate, directing the central agency to file its response.
The case has been scheduled for further hearing on August 6, 2026.
The High Court’s order pertains to the legal challenge against the cognisance order and does not amount to a determination on the merits of the allegations, which remain subject to judicial proceedings.
