The Food Safety and Standards Authority of India (FSSAI) on Thursday announced enforcement action against multiple food business operators (FBOs), including prohibiting the sale of two products over misleading claims and regulatory violations.
The food regulator said the action forms part of its efforts to protect consumer interests and includes prohibition orders, licence suspension and other measures against businesses found violating food safety, labelling and advertising norms.
Among the major actions, FSSAI issued a prohibition order against Vatave Health Care for the manufacture, storage, distribution and sale of its product, ‘FOLINEURO Syrup – Folinic Acid Syrup’.
According to the regulator, the product’s name, ‘FOLINEURO’, along with the image of a brain displayed on the front of the packaging, created a misleading impression that it was intended to support or improve brain and neurological functions.
FSSAI further noted that the product had been classified as a “Nutritional Food Supplement”, a category that is not recognised under the Food Safety and Standards (Health Supplements and Nutraceuticals) Regulations, 2016.
Based on a complaint, product labels, licence details and available records, the regulator said the product appeared to be in violation of provisions of the Food Safety and Standards Act, 2006. It prohibited the manufacture, processing, packaging, storage, transportation, distribution, marketing and sale of the product with immediate effect, warning that any violation would invite legal and penal action.
In a separate order, FSSAI prohibited the sale of ‘Neuherbs TRUE VITAMIN’, marketed by Global Healthfit Retail India Private Limited, citing the use of the trade name “TRUE VITAMIN”, which it said was misleading and not recognised under existing regulations.
The regulator stated that the branding violated the Food Safety and Standards (Advertising and Claims) Regulations, 2018, as well as the Food Safety and Standards (Labelling and Display) Regulations, 2020, as it had the potential to mislead consumers.
FSSAI has directed the company to immediately stop the sale of the product, remove the misleading claims from its labels and advertisements, and submit an Action Taken Report within 30 days. It warned that failure to comply could lead to further regulatory action.
