Former Delhi Minister and Aam Aadmi Party (AAP) leader Satyendar Kumar Jain and former Delhi Jal Board (DJB) CEO Udit Prakash Rai were among six people arrested by the Anti-Corruption Branch (ACB) of the Delhi government on Tuesday in an alleged corruption and tender-manipulation case involving sewage treatment plant (STP) projects.
The other four arrested accused have been identified as Ankit Srivastava, a former contractual consultant with the DJB; Nagendra Yadav, proprietor of M/s AN Enterprises; Raja Kumar Kurra, owner of M/s Euroteck Environment Private Limited; and Pankaj Verma, proprietor of M/s Srijanhar.
The arrests relate to an FIR registered on May 11, 2024, at the ACB police station on the basis of a complaint filed by the Directorate of Vigilance of the Government of the National Capital Territory of Delhi (GNCTD).
The FIR invokes Sections 7, 7A, 9 and 13 of the Prevention of Corruption Act, 1988, as amended in 2018, along with Sections 420, 409, 418 and 120-B of the Indian Penal Code.
According to the ACB, the investigation concerns alleged large-scale irregularities, manipulation of tender conditions and criminal conspiracy in the tendering process for augmentation and upgradation of DJB sewage treatment plants.
Investigators allegedly found that the tender contained restrictive technical specifications and conditions favouring M/s Euroteck Environment Private Limited, a private technology provider. The agency has alleged that the conditions curtailed competition and gave an undue advantage to the company.
The ACB also alleged that a proposed pilot study for the STP upgradation project was never conducted. It said restrictive conditions relating to the technology and media to be used were incorporated into the tender, while key parameters concerning treated effluent were omitted.
According to the agency, technical specifications were subsequently modified, allegedly resulting in significant financial implications for the government exchequer.
The investigation also examined communications between private individuals, public servants and intermediaries. The ACB said analysis of electronic evidence allegedly revealed exchanges involving tender conditions, corrigendums and other project-related documents, some of which were subsequently incorporated into the DJB tender.
The agency has alleged that these communications point to a nexus between private entities and public functionaries aimed at influencing tender conditions in favour of Euroteck.
The financial investigation has focused on an alleged flow of commission or bribe money through intermediary entities, including M/s Srijanhar and M/s AN Enterprises.
According to the ACB, substantial amounts were transferred to the proprietorship concern of accused Nagendra Yadav by entities linked to Euroteck. Investigators allegedly traced subsequent transactions involving transfers to former DJB CEO Udit Prakash Rai and his relatives.
The agency has alleged that Rai received bribes totalling around Rs 1.52 crore in his own and his relatives’ bank accounts through banking channels from M/s AN Enterprises. The ACB further alleged that the funds originated from Euroteck and were subsequently used to purchase immovable property.
The agency said it is continuing to examine the complete money trail and alleged proceeds of crime.
Investigators have also examined communications allegedly involving Raja Kumar Kurra, Nagendra Yadav and Ankit Srivastava concerning meetings, tender conditions and corrigendums related to the STP project.
The ACB said the electronic evidence indicates that certain restrictive conditions were allegedly introduced or modified in a manner favouring Euroteck. The agency is examining the respective roles of public functionaries, private entities and intermediaries in the alleged conspiracy.
According to the ACB, all six accused were questioned after investigators examined the material collected during the probe and were arrested on August 18 in accordance with law.
The arrests mark a major development in the investigation into alleged corruption and irregularities in the DJB’s STP upgradation projects. Further investigation is underway.
