The Calcutta High Court on Friday cautioned the Mamata Banerjee-led faction of the Trinamool Congress over the alleged violation of court-imposed conditions during its Martyrs’ Day rally held near Birla Planetarium in central Kolkata on July 21.
Hearing a petition alleging non-compliance with its earlier directions, Justice Saugata Bhattacharyya observed that the organisers had allegedly breached the court’s order by allowing participants in excess of the permitted limit and by blocking both carriageways near the venue.
The petitioner contended that the number of participants far exceeded the court-approved cap of 2,500, resulting in the closure of both lanes in front of Birla Planetarium despite a clear direction to keep one lane open for vehicular movement.
After hearing the matter, Justice Bhattacharyya expressed displeasure over the alleged violations and warned that the court would be compelled to take stricter action if its directions were disregarded in future.
The rally was held after the Calcutta High Court granted conditional permission, following the Kolkata Police’s refusal to allow the event at its traditional venue near Esplanade Crossing.
While permitting the gathering near Birla Planetarium, the court had imposed specific conditions, including limiting attendance to 2,500 people and ensuring that one lane remained open to facilitate traffic movement.
According to the petition, the turnout exceeded the prescribed limit, leading to heavy congestion in the area as both lanes were occupied during the programme.
