Advocate Sanket Gupta on Friday approached the Delhi Police seeking registration of an FIR against Lok Sabha Leader of Opposition Rahul Gandhi and Congress workers and supporters over their sit-in outside the office of the Deputy Commissioner of Police at Parliament Street Police Station.
Gupta’s complaint seeks action under Section 189 of the Bharatiya Nyaya Sanhita, 2023, alleging that the protest was held without permission and disrupted access to the police premises.
Rahul Gandhi had staged the sit-in to protest the alleged delay in registering an FIR on a complaint by a student who, according to the Congress, suffered pellet-gun injuries during protests at Jantar Mantar last month over education reforms.
Later on Friday, Delhi Police registered an FIR against unknown persons on the complaint of the alleged pellet-gun victim.
Speaking to IANS, Gupta said he had visited the New Delhi District Police office in connection with an earlier complaint but was unable to complete his work because of the protest.
“I have filed a complaint with the Delhi Police that if a protest is being held there, the sit-in demonstration should be conducted according to the rule of law. No one has the right to take the law and the Constitution for granted and stage a protest,” he said.
Gupta referred to a Supreme Court order to argue that while the right to protest exists, demonstrations must comply with applicable rules and regulations.
He alleged that the protesters had blocked entry and exit to the DCP office and constituted an unlawful assembly.
According to Gupta, gatherings involving more than five people are prohibited in the area because it is a sensitive zone in New Delhi. He said blocking access to a police office could hinder people seeking to submit urgent complaints.
“No one can block the entry and exit of a police station with their agitation,” Gupta said, reiterating his demand for action against those who allegedly violated public order.
