The Calcutta High Court on Monday quashed an arrest warrant issued against Trinamool Congress MP Mahua Moitra by a court in West Bengal’s Nadia district and transferred the related case to the MP-MLA court at Bidhannagar in North 24 Parganas district.
A division bench headed by Justice Debangshu Basak also set aside other related orders passed by the Krishnanagar District Court in the case.
Moitra, the two-time MP from Krishnanagar, was facing proceedings over allegedly controversial and insulting remarks concerning the Indian Army and Union Home Minister Amit Shah. Some of her comments relating to women wearing tulsi wood necklaces, burqa and hijab had also triggered controversy.
A Krishnanagar resident had filed the case under several provisions of the Bharatiya Nyaya Sanhita (BNS), 2023 and the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023. Moitra was accused of degrading the modesty of women, promoting conflict between religious groups, hurting religious sentiments and intimidating people.
The Krishnanagar court had issued summons to Moitra on several occasions. After she failed to appear, the court issued an arrest warrant against her.
Moitra subsequently moved the Calcutta High Court challenging the warrant. During an earlier hearing, the High Court had stayed its implementation on an interim basis.
The matter came up before the division bench again on Monday afternoon, when the court quashed the arrest warrant and ordered the transfer of the case.
Moitra’s counsel, Ark Nag, had earlier questioned whether the Krishnanagar court had jurisdiction over the matter since she is a sitting MP. He argued that the case should instead be heard by the designated MP-MLA court. The division bench accepted the contention and transferred the proceedings to the Bidhannagar MP-MLA court.
