Since past over three months i.e. with effect from 1st December 2024, one Anish Yadav, an IAS of 2014 batch is posted as Secretary in Haryana Human Rights Commission (H.H.R.C.). Additionally, Yadav also continues to be posted as Deputy Commissioner, Hisar and Administrator, HSVP- Hisar along with Additional Director, Urban Estate, Hisar since 3 November 2024.
Meanwhile, an Advocate at Punjab & Haryana High Court, Hemant Kumar, who keeps a close eye over administration and bureaucracy in the State of Haryana has sent a Legal Representation to Justice Lalit Batra (retired Judge of High Court) and currently Chairman of Haryana Human Rights Commission (HHRC) as well as its both Members viz.
Kuldip Jain and Deep Bhatia questioning the posting to Anish Yadav, as Secretary of HHRC since he is currently in Junior Administrative Grade (JAG) of IAS i.e. he is yet not in Secretary to the State Govt. rank.
Quoting Section 27(1)(a) of The Protection of Human Rights Act (P.H.R.A.), 1993 (Central Act No. 10 of 1994), Hemant poined that it stipulates that
an officer not below the rank of a Secretary to the State Government shall be the Secretary of the State Human Rights Commission. Hence, as per the aforementioned legal provision, Anish Yadav is not statutorily eligible for being posted as Secretary of H.H.R.C.
The Advocate has also written that there is no dearth/scarcity of Secretary rank IAS officers in the State of Haryana. Even two months ago with effect from 1st January 2025, half a dozen IAS officers of 2009 batch have also been promoted by the Haryana Government in Super Time Scale of IAS (Level 14 in the Pay Matrix) or in other words, they too are now in Secretary to the State Government rank.
Hemant asserted that there is no denying the fact that if duly enacted law of the Parliament of India viz. The Protection of Human Rights Act, 1993 expressly mandates appointment of an officer not below the rank of a Secretary to the State Government as Secretary of State Human Rights Commission, then the same is to be complied with meticulously and strictly by the State Government.
