The Delhi High Court has granted regular bail to a man accused of attacking his wife inside court premises during a matrimonial dispute after the woman told the court that she did not wish to pursue the case and wanted to resume her matrimonial life with him.
Justice Mini Pushkarna allowed the bail plea of Vijay Kumar in connection with a 2025 FIR registered at Dwarka South Police Station under Section 109(1) of the Bharatiya Nyaya Sanhita (BNS).
According to the court order, the couple had been involved in matrimonial disputes and regularly appeared before the court in connection with related proceedings. During a hearing on January 28, 2025, an altercation took place between them, following which Kumar allegedly attacked his wife inside the court premises. He was arrested the same day after the FIR was registered on his wife’s complaint.
The High Court noted that Kumar had earlier filed six bail applications before the trial court, of which four were withdrawn and two were dismissed. It also recorded that there was no previous incident involving him and that the complainant had withdrawn all matrimonial cases against him, including divorce and guardianship petitions.
The complainant appeared before the High Court and stated that she did not wish to pursue the present case against her husband. She also told the court that she had started visiting his family and wanted to return to the matrimonial home after his release.
The court was informed that the couple has an 11-year-old son and that the woman wished to resume her matrimonial life peacefully. The prosecution also said it had no objection to the grant of bail in view of the complainant’s stand.
“Accordingly, considering the overall conspectus of the facts and circumstances of the present case, this Court considers the present to be a fit case for grant of bail,” Justice Pushkarna said.
The High Court directed Kumar’s release on regular bail on furnishing a personal bond of Rs 25,000 and one surety of the same amount.
As conditions of bail, he was directed to appear before the trial court on every hearing date, provide his permanent and current residential addresses, and inform the investigating officer of any change in address. He must also keep his mobile number provided to the investigating officer or SHO operational throughout the trial.
The court further directed him to report to the jurisdictional police station every Monday at 9 a.m., with his release to follow within two hours after completion of the formalities.
Kumar was prohibited from directly or indirectly inducing, threatening or promising any person acquainted with the facts of the case, or from tampering with evidence. He was also directed not to commit any offence during the period of his release.
Justice Pushkarna directed the investigating officer to monitor the situation and act on any complaint in accordance with law.
The High Court clarified that its observations were confined to deciding the bail application and would neither affect the trial nor amount to an opinion on the merits of the case.
