The Delhi High Court has refused to grant anticipatory bail to a man accused of repeatedly impersonating senior government and constitutional functionaries, including allegedly posing as a civil servant and a judge of the Patna High Court to access confidential information from authorities.
While rejecting the bail plea of Manoj Kumar Jha, Justice Girish Kathpalia of the Delhi High Court also expressed concern over the failure of Delhi Police to arrest the accused despite repeated rejection of his anticipatory bail applications, including by the Supreme Court.
The court directed that a copy of its order be sent to the concerned Deputy Commissioner of Police for necessary action.
The case relates to an FIR registered in 2024 at Parliament Street police station under relevant provisions of the Bharatiya Nyaya Sanhita (BNS). According to the prosecution, Jha allegedly impersonated a civil servant and attempted to obtain sensitive confidential information from senior authorities. He was also accused of posing as a judge of the Patna High Court.
The accused’s counsel argued that since his anticipatory bail pleas had been rejected by courts in 2024 and 2025, and the Supreme Court had dismissed his Special Leave Petition (SLP) on September 8, 2025, the fact that he had not been arrested indicated that custodial interrogation was not required.
However, the Additional Public Prosecutor, along with the investigating officer, raised concerns before the court that no arrest had been made despite the Supreme Court declining anticipatory bail.
The High Court noted that Jha appeared to be a “habitual offender” and observed that there had been no change in circumstances after the apex court’s decision.
The court also took note of multiple criminal cases registered against him across different states, including allegations of impersonating a Patna High Court judge in Gurugram and cheating a person of Rs 80 lakh by allegedly posing as the Chairman of the National Highways Authority of India in a CBI case.
Several FIRs registered in Haryana, Bihar, Punjab and Chandigarh involving allegations of cheating, impersonation, forgery and related offences were also brought to the court’s notice.
Justice Kathpalia observed that apart from the nature of allegations, the accused’s criminal antecedents and judicial discipline also weighed against granting relief.
“Considering the above circumstances, I do not find it a fit case to grant anticipatory bail,” the court said.
The High Court further questioned the police action, stating that despite repeated rejection of bail pleas, including by the Supreme Court, the local police appeared to have taken no steps to arrest the accused.
The court observed that such inaction created an impression that the accused was being helped and that “there is something more that meets the eye”.
Justice Kathpalia directed that the order be forwarded to the concerned Deputy Commissioner of Police through the Senior Standing Counsel for information and necessary action.
