The Chief Judicial Magistrate (CJM) court in Ara has issued non-bailable warrants against 11 accused in the Bharat Tiwari encounter case, directing police to arrest them and produce them before the court by August 12.
The warrants have been issued in connection with Shahpur Police Station Case No. 178/2026, including against individuals whose names emerged during the course of the investigation.
The court has also directed the Superintendent of Police (SP), Ara, to appear before it on August 12 and submit a detailed report on the investigation, action taken so far and the status of the arrests.
Senior Supreme Court advocate Sanjeev Kumar Singh, who is representing Bharat Tiwari, said the warrants cover several police and STF personnel. Those named include then-SDM Sanjit Kumar, then-SDPO Rajesh Kumar Sharma, then-SHO Rajesh Malakar, police personnel Ankit Aryan and Harishchandra Kumar, STF personnel Akshay Kumar and Vikas Kumar, and ASI Ramashankar Yadav, among others.
According to Singh, STF personnel Akshay Kumar has already been arrested.
The court has sought details from the police on when the investigation commenced, the steps taken since then and the efforts made to apprehend the accused. It has also asked the investigating agency to explain notices issued to the accused, reasons for any delay in their arrest and the current status of the probe.
The Ara SP will accordingly have to inform the court about the number of arrests made and the action taken against those who remain at large.
The defence has also sought production of key evidence gathered during the investigation, including electronic records, mobile phone data, CCTV footage and witness statements.
Singh further submitted that Bharat Tiwari’s mobile phone had been seized by police and argued that digital devices and call or mobile records could contain important evidence relevant to the case.
The court’s latest directions put additional scrutiny on the investigation and are expected to be significant for the further proceedings in the Bharat Tiwari encounter case.
