Centre Clarifies ‘Unconditional Apology’ in SC Affidavit Over Oct 10 Delhi Protest Curbs

New Delhi, October 15, 2026 (Yes Punjab News)

The Union Home Ministry on Thursday clarified that the unconditional apology mentioned in the affidavit filed before the Supreme Court in connection with restrictions imposed during the October 10 Delhi protest was part of the standard procedure followed in contempt proceedings, and did not mean that the Union Home Secretary had personally admitted wrongdoing.

The clarification came after reports in some media organisations suggested that Union Home Secretary Govind Mohan had tendered an unconditional apology to the Supreme Court in response to a contempt notice concerning restrictions imposed in Delhi during a protest organised by the Cockroach Janata Party (CJP) against Chief Election Commissioner Gyanesh Kumar.

Describing such reports as misleading, the Ministry said that whenever the Supreme Court issues a contempt notice, the party responding to it is required to begin its affidavit with an unconditional apology before presenting its facts and arguments.

“This is mandatorily followed in every contempt petition. Following this practice, the first paragraph of the affidavits filed by the Home Secretary, Commissioner of Police, and other concerned officials complied with this requirement. Thereafter, detailed particulars in the affidavit have been furnished,” the Ministry said.

In its counter-affidavit filed before the Supreme Court on Wednesday, the Centre defended its decision to temporarily suspend mobile internet services in parts of central Delhi during the October 10 protest. It denied wilfully disobeying the court’s directions and maintained that the government and police had acted in accordance with the law.

The Centre argued that the temporary suspension of internet services was necessary to prevent a disturbance of public order and constituted a proportionate response to the prevailing circumstances.

The Ministry said the affidavit established that the actions taken by the government and police were lawful and that no case of contempt was made out against the officials concerned.

The Centre also urged the Supreme Court to discharge the contempt notice issued to Home Secretary Govind Mohan over the restrictions imposed during the protest.

In addition, the government sought a modification of the Supreme Court’s order to allow internet services to be suspended in circumstances where such action becomes necessary, provided the decision complies with the law and applicable statutory safeguards.
