The Himachal Pradesh government has proposed significant changes to stamp duty and property registration rules, including lower rates for women and substantially reduced charges for transfers of property among family members.
Revenue Minister Jagat Singh Negi announced the proposed changes during the Monsoon Session of the Himachal Pradesh Assembly on Tuesday, introducing the Indian Stamp (Himachal Pradesh Second Amendment) Bill, 2026.
The Bill seeks to replace the existing Schedule 1-A with a simplified and updated list of stamp-duty rates. The government said the move is aimed at modernising laws dating back to 1899 and eliminating confusion arising from frequent minor amendments to the existing provisions.
Under the proposed structure, a woman registering or receiving as a gift a property valued at up to ₹1 crore in her name would pay stamp duty at 4 per cent. For properties valued above ₹1 crore, the proposed rate is 8 per cent.
For men and others, stamp duty would be 6 per cent for property registrations valued up to ₹40 lakh and 8 per cent for properties above ₹40 lakh.
The Bill also proposes major relief for intra-family property transfers. Transfers between spouses and among blood relatives, including parents and children, would attract stamp duty of just 0.1 per cent of the property value.
The proposed provisions make no gender distinction in cases involving non-residents or acquisitions covered by Section 118 where special permission is obtained from the state government to acquire or lease land. Such transactions would attract stamp duty of 12 per cent.
The government has also proposed a ₹100 stamp for standard affidavits prepared at tehsil offices. The cost of executing adoption deeds would be fixed at ₹2,000.
The proposed changes are intended to simplify property-related transactions while providing greater relief in family property transfers and certain transactions involving women.
