Trinamool Congress MP Mahua Moitra on Thursday submitted a police complaint against Chief Election Commissioner (CEC) Gyanesh Kumar at Delhi’s Parliament Street Police Station, seeking registration of an FIR and an investigation into alleged irregularities in the Election Commission’s Special Intensive Revision (SIR) exercise. Police had not registered an FIR at the time of the reports.
In her complaint addressed to the Station House Officer, Moitra sought an investigation into the alleged offences, identification of the role of all persons involved, examination of relevant witnesses, including the two other Election Commissioners, and preservation of evidence.
“I request that a First Information Report be registered and the offences investigated, that the role of each person involved be ascertained, that the relevant witnesses, including the two Election Commissioners, be examined, and that the evidence be secured without delay so as to prevent its destruction or manipulation,” she wrote.
The Krishnanagar MP also sought a copy of the FIR if it is registered.
Moitra cited media reports alleging that Election Commissioners Sukhbir Singh Sandhu and Vivek Joshi had raised objections to several decisions and orders related to the SIR process. Reports published this week said the two commissioners had recorded objections on multiple occasions concerning voter additions, deletions, restoration of names and changes to the voter registration process.
She alleged that the functioning of the Election Commission had deviated from constitutional and statutory norms, including through an alleged reallocation of responsibilities relating to electoral rolls.
Moitra further alleged that communications were issued in the name of the Election Commission without approval from the full Commission. She argued that the CEC could not act on behalf of the Commission against the recorded opinions of the other commissioners and cited provisions of the Bharatiya Nyaya Sanhita in support of her allegations.
The TMC MP also alleged irregularities in the handling of electoral rolls, including the alleged marking of living and resident electors as absent, shifted or dead without the verification required by law.
Another allegation concerned Form 6, used for registering new voters. Moitra claimed that a question relating to an applicant’s or their parents’ or grandparents’ linkage with earlier electoral rolls was introduced without the corresponding amendment to the relevant rules. Media reports have also cited objections by Sandhu and Joshi to changes in Form 6.
Moitra further alleged that state-level election officials were denied complete access to electoral-roll systems and that appeals were filed against orders directing inclusion of certain electors without proper authority.
The allegations have emerged amid reported differences among the three Election Commissioners over aspects of the SIR process. The Election Commission has maintained that internal notes, observations and differences are part of institutional deliberations and has said that its official decisions have legal validity and that final decisions relating to SIR were taken unanimously.
Moitra has sought investigation into the allegations and action against those found responsible.
