Union Minister Jitan Ram Majhi on Sunday accused Union Minister and Lok Janshakti Party (Ram Vilas) chief Chirag Paswan of indulging in “unconstitutional work” amid differences within the National Democratic Alliance (NDA) over reservations for Scheduled Castes (SCs) and Scheduled Tribes (STs).
Majhi’s remarks came a day after Paswan opposed calls for introducing a “creamy layer” provision in SC/ST reservations and said those supporting such a move should first resign from their positions.
Paswan has maintained that reservation is not based on economic status but is intended to address centuries of social discrimination, exclusion and untouchability.
Speaking to IANS, Majhi said, “Whatever Chirag Paswan is doing is unconstitutional.”
He said the demand for “quota within a quota” had the backing of the Supreme Court, which had directed states to implement SC/ST sub-categorisation.

“It is unconstitutional because we are demanding ‘quota within a quota’ which has been supported even by the Supreme Court of India. It has given a majority verdict, directing states to implement it, and on the basis of this ruling, around half a dozen states in India have already implemented the same,” Majhi said.
“So what is there to resign for demanding what has already been implemented? One who is speaking against the Constitution should resign,” he added.
Majhi’s comments were in response to Paswan’s remarks targeting him and his son, Bihar Minister Santosh Suman. Paswan had said: “Let them support the concept of creamy layer and give up their respective posts.”
Majhi and Suman have been advocating sub-categorisation, or “quota within a quota”, arguing that reservation benefits have not reached all SC and ST communities equally. Suman has stressed that the demand is not intended to end reservation but to ensure that historically deprived groups receive their share.
Paswan, however, has argued that linking reservation to economic status could undermine its original purpose and called for a wider constitutional and parliamentary debate before any changes are introduced.
The Hajipur MP also questioned Congress and Lok Sabha Leader of Opposition Rahul Gandhi over the party’s responsibility for addressing social discrimination, arguing that Congress must also answer for persistent inequalities given its long tenure in power.
