The Aam Aadmi Party (AAP) in Punjab is preparing to seek the disqualification of two legislators, Chetan Singh Jouramajra and Harmeet Singh Pathanmajra, after they resigned from the party’s primary membership on Sunday.
The ruling party is expected to approach Punjab Assembly Speaker Kultar Singh Sandhwan, seeking action against Samana MLA Jouramajra and Sanaur MLA Pathanmajra under the anti-defection law.
AAP maintains that both legislators had already been suspended from the party over alleged anti-party activities. Their decision to quit the party has now prompted the leadership to consider moving the Speaker for their disqualification.
The development comes shortly after AAP released its first list of 40 candidates for the 2027 Punjab Assembly elections. The list did not include nominees for either Samana or Sanaur, the constituencies represented by the two legislators.
Their exit has also triggered speculation that they could join the Bharatiya Janata Party (BJP), although neither has officially confirmed their next political move.
Resignation from a political party’s primary membership does not, by itself, automatically end an MLA’s membership of the Assembly. Any disqualification under the anti-defection provisions of the Constitution would require consideration by the Speaker in accordance with the applicable rules.
The Speaker’s response to any formal petition by AAP is therefore likely to be significant in determining the legislative status of the two MLAs.
The developments have added to political activity in Punjab ahead of the 2027 Assembly elections, with the ruling party now facing the prospect of a formal dispute over the membership of two of its legislators.
