A fresh complaint has been filed against Kolkata-based businessman and real estate promoter Joy Kamdar, who was arrested earlier this year by the Enforcement Directorate (ED) in connection with alleged illegal land-grabbing cases, police said on Sunday.
The latest complaint names Joy Kamdar, his brother Tushar Kamdar and their company, Sun Constructions. The two brothers, residents of Ashwini Dutta Road in Kolkata, have been accused of cheating a person by allegedly promising him a share in profits from a property development project.
According to the complaint, the complainant was allegedly assured 25 per cent of the total profit if he helped arrange a particular property. Acting on the assurance, he arranged a housing project on a high-value property on Nepal Bhattacharya Street.
A written agreement was subsequently executed and construction work on the property was completed, the complainant alleged.
However, after the project was completed, the accused allegedly attempted to settle the matter by offering him a significantly smaller amount than what had been agreed upon. The complainant further alleged that the accused later denied the terms of the agreement.
He has accused Joy and Tushar Kamdar of obtaining possession of the property through fraud and betrayal and has approached the police, alleging criminal conspiracy and cheating. Police have initiated an investigation into the complaint.
The development came a day after Joy Kamdar approached the ED seeking to become an approver in the agency’s investigation into the alleged illegal land-grabbing cases.
According to sources, Kamdar’s counsel has also submitted a formal application before a special Prevention of Money Laundering Act (PMLA) court in Kolkata, where the case is being heard.
It is not yet clear whether the ED will accept Kamdar’s request or whether the court will grant him approver status. The special PMLA court has given the central agency until August 25 to communicate its decision on the proposal.
The broader investigation concerns an alleged land-grabbing nexus involving Kamdar, alleged land mafia kingpin Biswajit Poddar alias Sona Pappu, and former Kolkata Police Deputy Commissioner Santanu Sinha Biswas.
Kamdar was arrested in April, while Poddar and Sinha Biswas were taken into custody in May. Investigators have alleged that the three accumulated substantial illegal proceeds through land-grabbing operations.
