The Delhi High Court on Thursday indicated that it would pass an interim order directing the removal of certain objectionable online content allegedly linked to Bollywood actress Tabu, as it heard her plea seeking protection of her personality and publicity rights.
A single-judge Bench of Justice Jyoti Singh was hearing a suit filed by the actress against the alleged unauthorised use of her name, image, likeness and other identity attributes across digital platforms, including through artificial intelligence-generated content and digital impersonation.
During the hearing, senior advocate Swathi Sukumar, appearing for Tabu, informed the court that the memo of parties had been amended to correctly identify the social media intermediaries listed as defendants, in accordance with earlier directions.
The counsel submitted that certain online searches combining Tabu’s name with pornographic terms were leading users to objectionable content and alleged that platforms were benefiting from such searches.
Taking note of the submissions, Justice Singh observed that the identified links would have to be removed.
“They have to be taken down,” the court said while considering the request for immediate relief.
The court also indicated that it may frame a Standard Operating Procedure (SOP) to address similar matters involving alleged misuse of personality rights of public figures in the digital space.
The Delhi High Court said a detailed order would be passed later, and listed the matter for further hearing on December 7.
Tabu had approached the court alleging that her identity was being commercially exploited without authorisation through digital platforms. Her plea sought protection against misuse of her personality rights, including unauthorised use of her name, photographs, likeness and AI-generated representations.
The case is part of a growing trend of public figures approaching courts over the misuse of their identities online. Several celebrities and prominent personalities have sought legal protection against unauthorised use of their names, images and AI-generated impersonations.
Those who have approached or secured protection from courts in similar matters include former cricketers Gautam Gambhir and Sunil Gavaskar, spiritual leader Sri Sri Ravi Shankar, actors Arjun Kapoor, Allu Arjun, Nagarjuna, Varun Dhawan, Kajol, Aishwarya Rai Bachchan, Abhishek Bachchan and Naga Chaitanya, singer Jubin Nautiyal, filmmaker Karan Johar, podcaster Raj Shamani and Congress MP Shashi Tharoor.
