Bihar Leader of Opposition Tejashwi Yadav on Friday demanded action against Chief Minister Samrat Choudhary over a social media post that allegedly revealed the identity of the minor victim in the Jamui assault case, and said the RJD could approach the court if the police failed to act.
The photograph, showing Choudhary with the victim’s family, was posted on the Chief Minister’s social media account after he met the family and assured them of speedy justice and the strongest possible punishment for those found responsible. The post was later deleted. Reports said an FIR was subsequently registered against an employee of the Chief Minister’s Office in connection with the posting.
Yadav alleged that sharing the photograph amounted to disclosure of the minor’s identity and raised questions under the Protection of Children from Sexual Offences (POCSO) Act. He pointed to police action already taken against social media accounts accused of circulating material that could identify the victim.
Bihar Police have taken action against around 120 social media profiles over the circulation of the video related to the incident and warned against sharing material that could reveal the identity of the minor.
The RJD has indicated that if the police do not take action, it may seek legal intervention, including making the Bihar Police a party to the proceedings. Whether the deleted photograph itself constitutes an offence under the POCSO Act would depend on the facts and any determination by the competent authorities or a court.
The dispute follows the September 19 incident in Jamui, in which a minor boy and girl were allegedly intercepted and assaulted by a group of youths. Police registered a case under the POCSO Act and other relevant provisions and formed a Special Investigation Team. Several accused have been arrested, while the investigation into the incident and circulation of related material is continuing.
Yadav also criticised Union Minister and Lok Janshakti Party-Ram Vilas chief Chirag Paswan over his response to the incident. Paswan had separately condemned the episode and called for strict action against those responsible.
The RJD leader further reiterated his criticism of Chief Election Commissioner Gyanesh Kumar and said his party’s agitation would continue over its demand for action against him. He also called for a public clarification on questions being raised by the RJD over the functioning of the Election Commission.
