The Delhi government has granted consent to initiate criminal contempt proceedings against Ratna Singh, legal affairs head of the Cockroach Janta Party (CJP), over her social media remarks against a Judicial Magistrate at the Saket Court.
Additional Standing Counsel (Criminal) Amol Sinha granted the consent under Section 15(2) of the Contempt of Courts Act, 1971, after advocate Kaushik Chatterjee sought action against Singh.
In posts on X, Singh had accused the judicial officer of “serving the master” and acting under instructions from an external authority. She also questioned the conduct of the judge during a hearing and alleged that the Delhi Police was following orders from the same “master”.
In his response, Sinha said judicial orders could be criticised on grounds of their reasoning, legality and correctness. Citing the Supreme Court’s judgment in P.N. Duda v. V.P. Shiv Shankar (1988), he said fair criticism of judicial functioning must be distinguished from statements that scandalise or tend to lower the authority of a court.
However, he stressed that questioning a judicial decision was different from attributing external influence or improper motives to the judicial officer who delivered it.
Sinha clarified that the consent was based on a prima facie assessment and did not amount to a final determination of criminal contempt. The matter remains subject to independent consideration by the High Court.
