A single-judge vacation bench of the Calcutta High Court on Friday declined to hear the anticipatory bail plea of Sumit Roy, executive assistant to Trinamool Congress General Secretary and Diamond Harbour MP Abhishek Banerjee. The matter will be taken up by a regular bench after the court reopens on November 16.
Roy was arrested by Kolkata Police earlier this year in connection with an alleged land corruption case in Salboni, West Midnapore district. He had approached the Supreme Court seeking anticipatory bail, but after his plea was rejected, the police arrested him. He subsequently moved the Calcutta High Court challenging his arrest.
The matter came before Justice Arindam Mukhopadhyay on Friday. Roy’s counsel, former West Bengal Advocate General Kishore Dutta, argued that his client had been arrested in a five-year-old case for political reasons.
Opposing the plea, Additional Advocate General Rajdeep Majumdar, appearing for the state government, submitted that the investigation was at an initial stage and that granting bail could hamper the probe as investigators were still gathering information.
After hearing both sides, Justice Mukhopadhyay declined to comment on the merits of the case and said it would be heard by a regular bench after the festival vacation. Roy will therefore remain in custody during the upcoming Kali Puja and Diwali period.
Meanwhile, another case related to an alleged Rs 300 crore soil theft has been registered against Roy at Kalitala-Ashuti Police Station under Diamond Harbour Police in South 24 Parganas district. He is currently in police custody in connection with this second case.
On Thursday, Abhishek Banerjee alleged that Roy was being threatened with an encounter and pressured by the police to make statements against him.
