A court in Kerala’s Ernakulam district on Thursday refused to cancel the anticipatory bail earlier granted to the minor son of a judicial officer in a Mercedes-Benz hit-and-run case that claimed the life of a 55-year-old man.
The decision came despite objections from the prosecution and pleas by the victim’s family, which had sought cancellation of the bail.
The court observed that the law concerning juveniles was unambiguous and that the provisions of the Juvenile Justice Act had to be followed. It also criticised attempts to examine the case without considering the special legal safeguards available to children in conflict with the law.
Before passing its order, the court sought a police report within an hour on whether similar charges had been invoked in other cases in the district. When the hearing resumed, police informed the court that there were nine such cases. The court, however, declined to interfere with the earlier bail order.
The development came on the same day that the juvenile’s father, a judicial officer, secured anticipatory bail from another court in connection with the accident case.
The 55-year-old roadside eatery owner was allegedly run over by the Mercedes-Benz in the early hours of last month while returning home after closing his establishment.
The victim’s daughter expressed disappointment over the developments in both courts, saying the family was unable to understand what was happening and felt that ordinary people were finding it increasingly difficult to secure justice.
The two court decisions on the same day have come as a major setback to the family, which continues to seek justice for the deceased.
