The Delhi High Court has granted an ex-parte ad-interim injunction in favour of Haveli Restaurant and Resorts Ltd, led by Satish Jain, restraining Adison Resorts Ltd from using the brand name “Punjabi Haveli” or any other mark deceptively similar to “HAVELI.”
Justice Manmeet Pritam Singh Arora, while hearing CS (COMM) 791/2025, noted that Haveli Restaurant, which has operated under its registered trademark “HAVELI” since 2001, had established a prima facie case of trademark infringement and passing off. The Court observed that Adison Resorts had used similar branding, colour schemes, artistic elements, and interior themes, creating confusion among customers and infringing on Haveli’s goodwill.
The Court has ordered Adison Resorts to remove all boards, hoardings, social media accounts, and third-party listings using the disputed mark within one week of receiving the order. Failure to comply will result in the appointment of a Local Commissioner to enforce compliance.
Satish Jain’s Statement
Satish Jain, the head of Haveli Restaurant and Resorts Ltd, said he approached the Delhi High Court after facing significant social, business, and economic losses due to the defendant’s “clever” use of his registered logo.
According to Jain, Haveli’s trademark and logo, registered in English, Hindi, and Punjabi, have been in use since 2001. He alleged that Adison Resorts, operating from Ludhiana, began branding itself as “Punjabi Haveli,” intentionally displaying the word “Punjabi” in small font while prominently replicating Haveli’s English logo. This tactic, he said, misled customers into believing the defendant’s restaurant was affiliated with Haveli, resulting in complaints about poor service being directed to him.
Jain added that despite many businesses imitating his brand identity, they fail to deliver his company’s quality standards, causing him reputational harm. “We are suffering significant losses because customers associate poor service from imitators with our brand. That is why I am fighting this legal battle,” he said.
