How and if a sitting MLA of Haryana Vidhan Sabha is duly authorised or entitled to use the Emblem of Haryana Government on his official Letter-Pad notwithstanding the fact that a MLA (be he/she of Ruling or Opposition party or Independent in the Haryana Vidhan Sabha) is not part of the Haryana Government but rather of the Haryana State Legislature (read Legislative Assembly) and also particularly since Haryana Vidhan Sabha has got its own Emblem which is almost akin to the Emblem of Haryana Government except that that the former uses the words Haryana Vidhan Sabha in lieu of Government of Haryana in the latter.
The aforementioned point has been raised in a Memorandum cum Public Representation sent to the Governor of Haryana, Chief Minister, Speaker of Legislative Assembly and State Chief Secretary (who is also administrative secretary of state Parliamentary Affairs Department) by Hemant Kumar, an Advocate at Punjab & Haryana High Court in the aftermath of a recent fact pertaining to usage of Emblem of Haryana Government on the official Letter-Pad of one Naresh Selwal, sitting Cong party MLA of 15th Haryana Vidhan Sabha from Uklana Assembly Constituency in Hisar District.
Pertinent that on 22 Oct 2024, i.e. three days before the ibid MLA took Oath/Affirmation as MLA of current 15th Haryana Vidhan Sabha (which took place of 25 Oct 2024), he on his official Letter-Pad sent a letter communication addressed to then Chief Secretary, Haryana along with a copy to the same to Hon’ble Chief Minister, Haryana and Hon’ble Energy Minister, Haryana
Now in the aforementioned letter communication, on the official Letter-Pad of the above-mentioned Cong MLA, in the centre at the top, there is an imprint of the Emblem of Haryana Government.
Hence, in view of the above, Hemant has raised this interesting but significant point for clearance of ambiguity prevailing in this regard i.e. if a sitting MLA of Haryana Vidhan Sabha can use the State Emblem of Haryana Government on his official Letter-Pad ( and also on other mediums such as his/her Visiting Cards etc.).
