SBS Nagar Sessions Judge Bajwa awards life imprisonment to four accused of murder

District and Sessions Judge, Shaheed Bhagat Singh Nagar, Kanwaljit Singh Bajwa while pronouncing a judgement,has served a sentence to life imprisonment on four convicts in a case of murder and assault registered at Police station Banga in 2016.

The accused Charanjit Kumar alias Bagga son of Harbhajan Lal (31 years) resident of village Mehrampur, Rajinder Singh son of Sohan Lal (31 years) resident of village Mehrampur, Madan Lal son of Harbhajan Lal, (29 years) resident of village Mehrampur and Sohan Lal son of Rattan Chand son of Pheru Ram, ( 55 years) resident of village Mehrampur of police station Banga were sentenced to life imprisonment.

Finding all of them guilty of the offences registered against them as per evidence placed on record by the prosecution, the District and Sessions Judge, Kanwaljit Singh Bajwa said, “Therefore, it is held that the accused had intentionally caused grievous injuries to Sucha Ram and Kamaljit Kumar. Due to the fatal injuries suffered by Kamaljit Kumar at the hands of Rajinder Singh, he lost his life.

Therefore, on careful appraisal of evidence led on the file and appreciating the arguments advanced by both sides, on the criterion of law so deduced herein above, this Court reaches at an inescapable conclusion that the prosecution has successfully brought home guilt against all of the accused and they are liable to be convicted and as such all the accused are held guilty and convicted under Sections 302, 326 and 324 read with Section 34 of the Indian Penal Code, as well as, Section 506 of the Indian Penal Code, whereas, accused Charanjit Kumar alias Bagga and Madan Lal are also held guilty under Section 323 of the Indian Penal Code. Accordingly, all the points for determination are determined in favour of the prosecution and against the accused.

Pronouncing the quantum of sentence, the District and Sessions Judge said, “I have considered the pleas taken by the convicts and have gone through the record. Keeping in view the gravity and nature of the offence committed by them, convicts are not entitled to any leniency. Notably after initial altercation in the sweet shop of the complainant, the matter was diffused, but the present convicts did not allow the same to end up there and again attacked the complainant party in the Civil Hospital, Banga and had gone there fully armed with lethal weapons and in furtherance of common intention, caused the murder of Kamaljit Kumar and injuries to complainant Sucha Ram.

However, not finding it to be a case falling under the category of “rarest of rare case”, warranting Capital Punishment, all the convicts are sentenced as under–

Charanjit Kumar alias Bagga sentenced to Life Imprisonment under 302 read with Section 34 of IPC with a fine of Rs 10,000, Three Years of Rigorous Imprisonment under 326 with a fine of Rs 2,000, One Year of Rigorous Imprisonment under 324 read with 34 IPC with a fine of Rs 1,000, Six Months each under 323 and 506 of IPC with a fine of Five Hundred in both.

Rajinder Singh sentenced to Life Imprisonment under 302 read with Section 34 of IPC with a fine of Rs 10,000, Three Years of Rigorous Imprisonment under 326 with a fine of Rs 2,000, One Year of Rigorous Imprisonment under 324 read with 34 IPC with a fine of Rs 1,000, Six Months under 506 of IPC with a fine of Rs Five Hundred.

Madan Lal sentenced with Life Imprisonment under 302 read with Section 34 of IPC with a fine of Rs 10,000, Three Years of Rigorous Imprisonment under 326 read with section 34 of IPC with a fine of Rs 2,000, One Year of Rigorous Imprisonment under 324 read with 34 IPC with a fine of Rs 1,000, Six Months each under 323 and 506 of IPC with a fine of Five Hundred in both.

Sohan Lal sentenced to Life Imprisonment under 302 read with Section 34 of IPC with a fine of Rs 10,000, Three Years of Rigorous Imprisonment under 326 read with section 34 of IPC with a fine of Rs 2,000, One Year of Rigorous Imprisonment under 324 read with 34 IPC with a fine of Rs 1,000, Six Months under 506 of IPC with a fine of Rs Five Hundred.

The district and sessions Judge made it clear that all the substantive sentences awarded to the respective convicts shall run concurrently. The period already undergone by the convicts during the Investigation/ trial shall be set-off from the substantiate sentences to be undergone by them, as envisioned under Section 428 of the Code of Criminal Procedure.
