ਸਿੱਧੂ ਮੂਸੇਵਾਲਾ ਖਿਲਾਫ਼ ਐਫ.ਆਈ.ਆਰ. ਉਸਨੂੰ ਬਚਾਉਣ ਲਈ? ਪੜ੍ਹੋ ਵਕੀਲਾਂ ਵੱਲੋਂ ਕੈਪਟਨ ਅਮਰਿੰਦਰ ਨੂੰ ਲਿਖ਼ੀ ਚਿੱਠੀ

ਚੰਡੀਗੜ੍ਹ/ਨਵਾਂਸ਼ਹਿਰ 5 ਮਈ, 2020 –

ਪੰਜਾਬੀ ਗਾਇਕ ਸਿੱਧੂ ਮੂਸੇਵਾਲਾ ਵੱਲੋਂ ਏ ਕੇ ਸੰਤਾਲੀ ਰਾਈਫਲ ਨਾਲ ਕੀਤੇ ਜਾ ਰਹੇ ਫਾਇਰ ਪੁਲੀਸ ਦੇ ਨਿਸ਼ਾਨੇ ‘ਤੇ ਨਹੀਂ ਆਏ । ਪੰਜਾਬ ਦੇ ਸੋਸ਼ਲ ਐਕਟਿਵਿਸਟਾਂ ਐਡਵੋਕੇਟ ਹਾਕਮ ਸਿੰਘ ਚੰਡੀਗੜ੍ਹ, ਪਰਵਿੰਦਰ ਸਿੰਘ ਕਿੱਤਣਾ ਨਵਾਂਸ਼ਹਿਰ, ਕੁਲਦੀਪ ਸਿੰਘ ਖਹਿਰਾ ਲੁਧਿਆਣਾ ਅਤੇ ਅਮਰਜੀਤ ਸਿੰਘ ਮਾਨ ਸੰਗਰੂਰ ਨੇ ਪੁਲਸ ‘ਤੇ ਗੰਭੀਰ ਦੋਸ਼ ਲਗਾਏ ਹਨ । ਇਨ੍ਹਾਂ ਐਕਟੀਵਿਸਟਾਂ ਨੇ ਸਵਾਲ ਕੀਤਾ ਹੈ ਕਿ ਕੀ ਬਰਨਾਲਾ ਪੁਲਸ ਨਹੀਂ ਜਾਣਦੀ ਕਿ ਏ.ਕੇ. ਸੰਤਾਲੀ ਦੀ ਵਰਤੋਂ ਸਿਰਫ ਪੁਲਸ ਵਲੋਂ ਹੀ ਕੀਤੀ ਜਾਂਦੀ ਹੈ ਤੇ ਕਿਸੇ ਹੋਰ ਵਿਅਕਤੀ ਵੱਲੋਂ ਇਸ ਦੀ ਵਰਤੋਂ ਕਰਨ ‘ਤੇ ‘ਅਸਲਾ ਐਕਟ’ ਤਹਿਤ ਕਾਰਵਾਈ ਹੋਣੀ ਹੈ ।

ਪੰਜਾਬ ਦੇ ਮੁੱਖ ਮੰਤਰੀ,ਗ੍ਰਹਿ ਤੇ ਨਿਆਂ ਵਿਭਾਗ ਦੇ ਸਕੱਤਰ ਅਤੇ ਡੀਜੀਪੀ ਪੰਜਾਬ ਨੂੰ ਪੱਤਰ ਭੇਜ ਕੇ ਇਨ੍ਹਾਂ ਐਕਟੀਵਿਸਟਾਂ ਨੇ ਸਿੱਧੂ ਮੂਸੇਵਾਲਾ ਫਾਇਰਿੰਗ ਮਾਮਲੇ ਵਿਚ ਐੱਸ.ਆਈ.ਟੀ. (ਸਪੈਸ਼ਲ ਇਨਵੈਸਟੀਗੇਸ਼ਨ ਟੀਮ) ਬਣਾਉਣ ਦੀ ਮੰਗ ਕੀਤੀ ਹੈ ਜਿਸ ਵਿੱਚ ਘੱਟ ਤੋਂ ਘੱਟ ਦੋ ਆਈਪੀਐੱਸ ਅਫਸਰ ਹੋਣ । ਪੱਤਰ ਵਿਚ ਲਿਖਿਆ ਗਿਆ ਹੈ ਕਿ ਵਾਇਰਲ ਹੋਈ ਵੀਡੀਓ ਵਿੱਚ ਪੰਜਾਬੀ ਗਾਇਕ ਸਿੱਧੂ ਮੂਸੇ ਵਾਲਾ ਏ.ਕੇ. ਸੰਤਾਲੀ ਰਾਈਫਲ ਨਾਲ ਫਾਇਰ ਕਰ ਰਿਹਾ ਹੈ ਅਤੇ ਕੁਝ ਪੁਲਿਸ ਮੁਲਾਜ਼ਮ ਉਸ ਦਾ ਸਾਥ ਦੇ ਰਹੇ ਹਨ ।

ਲੇਕਿਨ ਉਕਤ ਮਾਮਲੇ ਸਬੰਧੀ ਪੁਲਸ ਥਾਣਾ ਧਨੌਲਾ ਜ਼ਿਲ੍ਹਾ ਬਰਨਾਲਾ ਵਿਖੇ ਜੋ ਐੱਫ. ਆਈ. ਆਰ. ਦਰਜ ਕੀਤੀ ਗਈ ਹੈ ਉਸ ਵਿੱਚ ਸਿਰਫ਼ ਕਰਫਿਊ ਦੀ ਉਲੰਘਣਾ ਕਰਨ ਤੇ ਬੀਮਾਰੀ ਫੈਲਾਉਣ ਦੀ ਕੋਸ਼ਿਸ਼ ਸਬੰਧੀ ਆਈਪੀਸੀ ਦੀ ਧਾਰਾ 188 ਅਤੇ ਡਿਜਾਸਟਰ ਮੈਨੇਜਮੈਂਟ ਐਕਟ 2005 ਲਗਾਏ ਗਏ ਹਨ । ਇਸ ਨਾਲ ਦੋਸ਼ੀਆਂ ਨੂੰ ਖਾਨਾਪੂਰਤੀ ਲਈ ਥਾਣੇ ਵਿੱਚੋਂ ਹੀ ਜ਼ਮਾਨਤ ਕਰਵਾਉਣੀ ਸੌਖੀ ਹੋ ਜਾਵੇਗੀ ।

ਪੱਤਰ ਵਿਚ ਇਥੋਂ ਤੱਕ ਕਿਹਾ ਗਿਆ ਹੈ ਕਿ ਇਹ ਸਿੱਧੇ ਤੌਰ ਤੇ ਦੋਸ਼ੀਆਂ ਨੂੰ ਬਚਾਉਣ ਦਾ ਯਤਨ ਹੀ ਜਾਪਦਾ ਹੈ।ਕੀ ਐਫਆਈਆਰ ਦਰਜ ਕਰਨ ਵੇਲੇ ਪੁਲਸ ਨੂੰ ਇਹ ਨਹੀਂ ਸੀ ਪਤਾ ਕਿ ਕਿਸੇ ਗ਼ੈਰ ਪੁਲਿਸ ਮੁਲਾਜ਼ਮ ਵਿਅਕਤੀ ਵੱਲੋਂ ਗੋਲੀਆਂ ਚਲਾਉਣਾ ਅਪਰਾਧ ਹੈ ਤੇ ਇਸ ਅਪਰਾਧ ਲਈ ‘ਦਾ ਆਰਮਜ਼ ਐਕਟ 1959 (ਸਮੇਤ ਦਾ ਆਰਮਜ਼ (ਅਮੈਂਡਮੈਂਟ) ਐਕਟ 2019 ) ਤਹਿਤ ਕਾਰਵਾਈ ਹੋਣੀ ਚਾਹੀਦੀ ਹੈ ?

ਦੋਸ਼ੀਆਂ ‘ਤੇ ‘ਆਰਮਜ਼ ਐਕਟ 1959 ( ਸਮੇਤ ਆਰਮਜ਼ (ਅਮੈਂਡਮੈੰਟ) ਐਕਟ 2019 ) ਲਗਾਉਣ ਅਤੇ ਸਿੱਧੂ ਮੂਸੇ ਵਾਲਾ ਤੇ ਹੋਰ ਵਿਅਕਤੀਆਂ ਅਤੇ ਪੁਲਿਸ ਮੁਲਾਜ਼ਮਾਂ ਵਲੋਂ ਵਰਤੇ ਗਏ ਹਥਿਆਰਾਂ ਨੂੰ ਬਤੌਰ ਕੇਸ ਪ੍ਰਾਪਰਟੀ ਤੁਰੰਤ ਕਬਜ਼ੇ ਲੈਣ ਦੀ ਵੀ ਮੰਗ ਕੀਤੀ ਗਈ ਹੈ । ਇਹ ਵੀ ਗਿਆ ਹੈ ਕਿ ਘਟਨਾ ਸਥਾਨ ‘ਤੇ ਗਏ ਵਿਅਕਤੀਆਂ ਵਿੱਚ ਕੁਝ ਪੁਲਸ ਅਫਸਰਾਂ ਦੇ ਪਰਿਵਾਰਕ ਮੈਂਬਰਾਂ ਦੇ ਹੋਣ ਦੀ ਸ਼ੰਕਾ ਜਤਾਈ ਜਾ ਰਹੀ ਹੈ ਜਿਸ ਦੀ ਬਰੀਕੀ ਨਾਲ ਜਾਂਚ ਕਰਕੇ ਉਨ੍ਹਾਂ ਨੂੰ ਵੀ ਨਾਮਜ਼ਦ ਕੀਤਾ ਜਾਣਾ ਚਾਹੀਦਾ ਹੈ । ਆਪਣੀ ਮੰਗ ਪੂਰੀ ਨਾ ਹੋਣ ਦੀ ਹਾਲਤ ਵਿੱਚ ਪੰਜਾਬ ਤੇ ਹਰਿਆਣਾ ਹਾਈ ਕੋਰਟ ਪਹੁੰਚ ਕਰਨ ਦੀ ਚੇਤਾਵਨੀ ਵੀ ਦਿਤੀ ਗਈ ਹੈ ।

Subject: for imposing ‘Arms Act 1959’ including ‘Arms (Amendment) Act 2019 on the accused; immediate sending all the weapons issued to all accused for forensic testing and preserve them as case property.

In Ref.: In continuation of the complaint made by us on 04 May 2020 at 12.49 pm followed by amended complaint at 3.15 P.M. via e-mail.

Sirs,

Vide above referred complaint, we had informed you about a video going viral on social media in which Punjabi singer Shubhdeep Singh @ Sidhu Musewala, accompanied by some policemen, was firing from AK-47 rifle. However, in connection with said crime, an FIR vide No. 57 dated 14.04.2020 (based upon information received from the unnamed source) has been registered at PS Dhanaula, District Barnala.

Instead of lodging the FIR u/s 29, 30 of Arms Act and section 115, 119 of IPC against the policemen and u/s 25, 29, 30 of Arms Act and 336 and 120-B of IPC and u/s 67 of IT Act against the civilians including Shubhdeep Singh @ Sidhu Musewala, only Section 188 of the IPC and the Disaster Management Act 2005 have been enacted in the FIR to dilute the crime and facilitate the accused to get the bail in the police station level. This seems to be a direct attempt to save the accused.

Although in the FIR it has been mentioned that informer informed that accused (all named) have fired from weapons in the fields of Karam Singh Lahal in Village Badbar and a video is going viral regarding the crime. It has also been mentioned in the FIR that information is reliable and true. Didn’t the police, at the time of filing the FIR, know that shooting by a civilian was a crime and should be prosecuted under the Arms Act 1959 (including the Arms (Amendment) Act 2019)?

We make the following request to you through this letter:

1. The Arms Act, 1959 (including the Arms (Amendment) Act, 2019) must be
imposed on the accused.

2. A SIT (Special Investigation Team) consisting of at least two IPS officers should be formed for investigation as the accused are from policemen also.

3. Weapons used by Sidhu Musa Wala, other persons and all the weapons issued to the accused police personnel should be immediately recovered and seized and sent to Forensic lab for testing and preserve as the case property.

4. As per another video, firing took place in 2 places (in one place fired from pistols and other one from AK-47 rifle in the fields of village Badbar). It is suspected that some of the persons, who went to the spot, were family members of some police officers who should also be nominated after a thorough investigation. This video is also hereby attached with representation.

Of course, if our demand is not met, we will approach the Punjab and Haryana High Court.
