A Supreme Court lawyer has urged Chief Justice of India (CJI) Surya Kant to consider initiating suo motu criminal contempt proceedings over a now-deleted social media post by the Congress’ Kerala unit targeting the CJI, as well as reports of sloganeering and a protest inside the Supreme Court premises.
In a complaint-cum-representation to the CJI, advocate Vineet Jindal sought an examination of whether the social media post and the reported demonstration during the Opposition’s protest march raised issues warranting legal action, particularly in view of concerns over the security and functioning of the apex court.
The Congress Kerala unit had posted on X: “Dear Surya Kant, If law and order is not your domain, resign now. We will find your replacement who can handle it.”
Jindal requested that the post be assessed in its full factual and legal context to determine whether it constituted permissible political criticism or warranted consideration under Section 2(c) of the Contempt of Courts Act, 1971. He also invoked Article 129 of the Constitution, which empowers the Supreme Court to punish for contempt of itself.
The lawyer further sought scrutiny of the reported demonstration during the filing of a petition by Leader of Opposition Rahul Gandhi and other INDIA bloc leaders. He urged authorities to examine whether protesters entered restricted areas without authorisation, violated security instructions or obstructed the court’s functioning. He also called for the preservation and examination of CCTV footage, access-control logs and security deployment records before any conclusions were reached.
Earlier, the Supreme Court Bar Association (SCBA) and the Supreme Court Advocates-on-Record Association (SCAORA) had separately condemned statements calling for the CJI’s resignation, warning that such remarks could undermine judicial dignity and interfere with the administration of justice.
The INDIA bloc held its march on Monday to protest alleged electoral irregularities and the Special Intensive Revision (SIR) of electoral rolls. Opposition leaders subsequently approached the Supreme Court with a joint petition challenging the revision process.
During a mentioning before the court on Tuesday, senior advocate Gaurav Bhatia raised a related matter. When CJI Surya Kant asked, “Is it in the mentioning list?”, Bhatia replied in the negative. The CJI then said, “Just mention tomorrow.”
Meanwhile, Delhi Police have registered four FIRs in connection with the protest march, according to police sources. Two cases were registered at Tilak Marg police station and one each at Mandir Marg and Barakhamba police stations over alleged violations of Section 163 of the Bharatiya Nagarik Suraksha Sanhita (BNSS).
Separately, several protesters, including Cockroach Janata Party (CJP) members Ashutosh Ranka and Saurav Das, were detained at Jantar Mantar during a flash protest.
