BJP national spokesperson Sambit Patra has rejected Leader of Opposition Rahul Gandhi’s allegations over Form 6, the Election Commission and the Special Intensive Revision (SIR) of electoral rolls, accusing him of misrepresenting the Supreme Court’s observations.
Addressing a press conference in New Delhi, Patra said Gandhi had wrongly suggested that the Supreme Court had established that Chief Election Commissioner Gyanesh Kumar illegally and unilaterally altered Form 6 to benefit the BJP.
Patra said the Supreme Court had neither declared Form 6 illegal nor rejected it. According to him, the court had only made it clear that it had not approved any modified version of the form and wanted to examine the official record to determine who had made the changes.
He referred to Chief Justice Surya Kant’s observation during the hearing that the court had not approved the changed Form 6 and that the records would have to be examined to establish who was responsible for the modification. Patra said this could not be treated as a judicial finding that Form 6 itself was unlawful.
The BJP spokesperson also cited the Election Commission’s September 26 press release, which stated that the declaration attached to Form 6 for the SIR exercise had been upheld by the Supreme Court. He alleged that Gandhi was creating confusion by portraying the issue as though the entire form had been declared illegal.
Gandhi, in a post on X, had alleged that the Supreme Court proceedings established that the CEC had changed Form 6 illegally and unilaterally, and described it as evidence of alleged misuse of the office to benefit the BJP.
Patra also disputed the claim that the SIR decision was taken unilaterally. He said the Bihar SIR order issued on June 24, 2025, was approved unanimously by all three Election Commissioners, citing the Election Commission’s own position.
He further rejected claims that the Commission had withdrawn its September 26 press release, saying it remained part of the public record and that the Election Commission had subsequently issued a fact-check on the matter.
Patra also referred to Gandhi’s earlier criticism of the Supreme Court during the Rafale controversy, alleging that he had previously misrepresented the court’s observations in that case.
The BJP leader urged political leaders to examine judgments and official documents carefully before making public allegations involving constitutional institutions.
