Chandigarh MP Manish Tewari has questioned the Minister of Housing and Urban Affairs on whether any impact assessment has been undertaken regarding the Order on Need-Based Changes in Chandigarh Housing Board (CHB) Dwelling Units issued by the CHB Chairman vide No. PA/CEO/EA1/2023/02 dated 03.01.2023, and if so, sought details thereof.
Taking up the matter vide Unstarred Question No. 6298 in Parliament, Tewari asked whether any stakeholder consultations have been conducted or are proposed to be conducted, after the date of the said Order and if so, the details thereof, and if not, the reasons therefor.
“What is the number and nature of grievances received from residents, RWAs and allottees regarding the said Order and the Chandigarh Building Bye-laws, particularly on eligibility, penalties and procedural rigidities from 2023 to 2025, year-wise,” Tewari asked.
The MP also sought to know whether the Government/UT Administration is considering amending, relaxing or rationalising the Chandigarh Building Rules (Urban), 2017 adding, “If so, the details thereof and if not, the reasons therefor.”
Responding to Tewari’s question, the Minister of State for Housing and Urban Affairs Tokhan Sahu replied, “As per the information provided by Union Territory of Chandigarh Administration, no impact assessment of the above-mentioned Order has been undertaken. However, stakeholder consultations have been held in respect of the implementation of Clause 20 of the said Need Based Changes (NBC) Order.”
The Minister also said that at present, no proposal to amend, relax or rationalise the Chandigarh Building Rules (Urban), 2017 is under consideration with Chandigarh Administration. “The Chandigarh Building Rules-2017 have been notified after holistic analysis of existing byelaws of neighbouring states and provides parameters for all kinds of buildings”, he asserted.
It is unfortunate that the Government is not taking a humane approach to the chronic issues of 3.5 Lakh residents of Chandigarh Housing Board allottees who have been suffering for the past 25 years.
