Contempt Plea in SC Against Delhi Police Chief, DMRC Chairperson Over Metro Restrictions

A contempt petition has been filed in the Supreme Court against senior officials, including Delhi Police Commissioner Anurag Kumar and Delhi Metro Rail Corporation (DMRC) Chairperson D. Thara, alleging non-compliance with the court’s October 9 order on restrictions imposed on Metro and railway services ahead of a proposed protest at Jantar Mantar.

The petition, filed by advocate Shailendra Mani Tripathi, has sought contempt proceedings against Union Home Secretary Govind Mohan, Delhi Police Commissioner Anurag Kumar and DMRC Chairperson D. Thara. It alleges that authorities failed to implement the Supreme Court’s direction that Metro train services should not be completely suspended in the national Capital.

According to the plea, entry and exit gates at several Metro stations remained closed, while train services continued to be cancelled or curtailed, causing inconvenience to commuters and disrupting public life.

Tripathi alleged that the DMRC had announced the closure of entry and exit gates at 45 Metro stations. He claimed that when he visited GTB Nagar and Vishwavidyalaya Metro stations at around 9.30 p.m., he found their entry gates shut and recorded the closures on video.

The petition also alleged that authorities had failed to adequately publicise revised travel arrangements and continued to impose restrictions despite the court’s directions.

Referring to a visit to Jantar Mantar at around 8.30 p.m., the petitioner claimed that only police and paramilitary personnel were present at the protest site and that no protesters were there at the time. The plea described the alleged non-compliance as a disruption to public life and sought the immediate withdrawal of blanket restrictions on Metro and other railway services.

The contempt plea follows a Supreme Court order passed on Friday by a Bench comprising Chief Justice of India Surya Kant and Justices Joymalya Bagchi and V. Mohana. The Bench directed that there should be no complete stoppage of Metro train services ahead of the proposed demonstration by the Cockroach Janta Party (CJP), which is demanding accountability from Chief Election Commissioner Gyanesh Kumar.

During the hearing, the court distinguished between completely prohibiting train movement and regulating services, stressing that preventive measures should be proportionate to the anticipated law-and-order situation.

“In terms of that assurance, we make it clear that there shall be no complete prohibition on the movement of Metro trains,” the court said, recording an assurance from Solicitor General Tushar Mehta that authorities would reconsider the restrictions and allow services to operate in a regulated manner.

The Supreme Court also directed authorities to publicise their decisions on regulated Metro and railway operations and issue a traffic advisory to minimise inconvenience to commuters.

The restrictions had included reduced Metro train frequency at 57 stations and the closure of entry and exit gates from 9 p.m. on October 9, continuing on October 10 until the situation normalised. The measures were imposed amid concerns about the proposed protest and the potential movement of crowds towards sensitive locations.

The court further directed the DMRC, the concerned railway authorities and Delhi Police (Traffic) to submit compliance reports within four days. It also asked the competent authorities to consider identifying suitable alternative protest sites equipped with basic amenities and infrastructure to facilitate peaceful and lawful demonstrations.

Delhi Police had denied permission for the proposed protest, citing public safety, traffic management and law-and-order concerns. The police also referred to prohibitory orders under Section 163 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) in the New Delhi area.
