The dismissal of the US legal proceedings against Adani Group Chairman Gautam Adani has effectively brought the case to an end and removed a potential impediment to his business activities, legal experts said on Tuesday, while market analysts described the development as positive for investor sentiment.
Senior advocate Raian Karanjawala, Managing Partner of Karanjawala & Co, said the proceedings against Adani had been completely closed and could not be revived on the same set of facts.
According to Karanjawala, the court’s decision means there is no pending case against Adani in the US and he can continue conducting business internationally without the legal impediment posed by the proceedings.
He said the US Department of Justice had sought withdrawal of the case and the judge had granted permission, bringing the proceedings against Adani to a close.
Senior advocate and Supreme Court Bar Association President Vikas Singh also termed the order significant. He pointed to the court’s observation that the government should ideally have consulted the investigating agencies or prosecution wing before seeking closure of the case.
Singh said the decision was important because the Department of Justice had sought withdrawal after concluding that the prosecution should not have been initiated in the first place.
Senior advocate Vikas Pahwa likewise described the order as highly significant for the Adani Group, which has a substantial international business presence.
Market analyst Arun Kejriwal said the US proceedings had not materially affected the group’s operations in India, noting that infrastructure projects and business expansion continued during the period.
Kejriwal termed the development a major victory for Adani and said the absence of any judicial findings against him effectively provided investors with a clean slate in assessing the businessman and the group.
