ਪੰਜ ਵਾਰ ਪੰਜਾਬ ਦੇ ਮੁੱਖ ਮੰਤਰੀ ਸਰਦਾਰ ਪ੍ਰਕਾਸ਼ ਸਿੰਘ ਬਾਦਲ ਨੇ ਸਪਸ਼ਟ ਤੌਰ ’ਤੇ ਕਾਨੂੰਨ ਨਾਲ ਸਹਿਯੋਗ ਦੀ ਆਪਣੀ ਮਨਸ਼ਾ ਤੇ ਵਚਨਬੱਧਤਾ ਮੁੜ ਦੁਹਰਾਈ ਹੈ ਤੇ ਕਿਹਾ ਹੈ ਕਿ ਉਹਨਾਂ ਨੁੰ ਨਿਆਂਪਾਲਿਕਾ ਵਿਚ ਪੂਰਾ ਵਿਸ਼ਵਾਸ ਹੈ।
ਸਿਹਤ ਠੀਕ ਨਾ ਹੋਣ ਕਾਰਨ ਉਹਨਾਂ ਨੇ ਐਸ ਆਈ ਟੀ ਪੇਸ਼ੀ ਲਈ ਨਵੀਂ ਤਾਰੀਕ ਤੈਅ ਕਰਨ ਲਈ ਆਖਿਆ ਕਿਉਂਕਿ ਉਹਨਾਂ ਨੂੰ ਡਾਕਟਰਾਂ ਨੇ 10 ਦਿਨਾਂ ਲਈ ਪੂਰਾ ਆਰਾਮ ਕਰਨ ਦੀ ਸਲਾਹ ਦਿੱਤੀ ਹੈ।
ਉਹਨਾਂ ਕਿਹਾ ਕਿ ਜਿਵੇਂ ਹੀ ਮੇਰੀ ਸਿਹਤ ਠੀਕ ਹੁੰਦੀ ਹੈ ਤਾਂ ਉਹ ਕਾਨੂੰਨ ਮੁਤਾਬਕ ਆਪਣੀ ਰਿਹਾਇਸ਼ ਫਲੈਟ ਨੰਬਰ 37, ਸੈਕਟਰ 4 ਚੰਡੀਗੜ੍ਹ ਵਿਖੇ ਜਾਂਚ ਵਿਚ ਸ਼ਾਮਲ ਹੋਣ ਲਈ ਹਾਜ਼ਰ ਰਹਿਣਗੇ।
ਸਰਦਾਰ ਬਾਦਲ ਨੇ ਆਸ ਪ੍ਰਗਟ ਕੀਤੀ ਕਿ ਇਹ ਐਸ ਆਈ ਟੀ ਪਹਿਲੀ ਐਸ ਆਈ ਦੇ ਉਲਟ ਕਾਨੂੰਨ ਦਾ ਸਨਮਾਨ ਕਰੇਗੀ ਅਤੇ ਇਕ ਨਿਰਪੱਖ ਜਾਂਚ ਕਰੇਗੀ ਤੇ ਸੱਤਾਧਾਰੀ ਪਾਰਟੀ ਦੇ ਸਿਆਸੀ ਦਖਲ ਅੱਗੇ ਗੋਡੇ ਨਹੀਂ ਟੇਕੇਗੀ ਕਿਉਂਕਿ ਸਰਕਾਰ ਆਪਣੇ ਸੌੜੇ ਸਿਆਸੀ ਹਿੱਤਾਂ ਵਾਸਤੇ ਕਾਨੂੰਨ ਨੂੰ ਛਿੱਕੇ ਟੰਗ ਰਹੀ ਹੈ।
ਪਿਛਲੀ ਸਰਕਾਰ ਵੇਲੇ ਕੋਟਕਪੁਰਾ ਹੋਈਆਂ ਘਟਨਾਵਾਂ ਦੀ ਜਾਂਚ ਕਰ ਰਹੀ ਐਸ ਆਈ ਟੀ ਵੱਲੋਂ ਪ੍ਰਾਪਤ ਹੋਏ ਸੰਮਨਾਂ ਦਾ ਦੋ ਸਫਿਆਂ ਦਾ ਜਵਾਬ ਦਿੰਦਿਆਂ ਸਰਦਾਰ ਬਾਦਲ ਨੇ ਕਿਹਾ ਕਿ ਅੱਜ ਤੱਕ ਸਿਆਸੀ ਦਖਲ ਕਾਰਨ ਜਾਂਚ ਦੀ ਸਾਰੀ ਪ੍ਰਕਿਰਿਆ ਨਾਲ ਮਜ਼ਾਕ ਕੀਤਾ ਗਿਆ ਹੈ ਤੇ ਇਸਦਾ ਮਕਸਦ ਸਿਆਸੀ ਬਦਲਾਖੋਰੀ ਸੀ ਜਿਸ ਕਾਰਨ ਜਾਂਚ ਦੀ ਨਿਰਪੱਖਤਾ ’ਤੇ ਕਿਸੇ ਨੁੰ ਭਰੋਸਾ ਨਹੀਂ ਰਿਹਾ।
ਉਹਨਾਂ ਕਿਹਾ ਕਿ ਇਸਸਭ ਦੇ ਬਾਵਜੂਦ ਉਹ ਜਾਂਚ ਪ੍ਰਕਿਰਿਆ ਵਿਚ ਪੂਰਾ ਸਹਿਯੋਗ ਕਰਨਗੇ।
ਸਾਬਕਾ ਮੁੱਖ ਮੰਤਰੀ ਨੇ ਕਿਹਾ ਕਿ ਮੌਜੂਦਾ ਐਸ ਆਈਟੀ ਤਾਂ ਵਜੂਦ Ç ਵਚ ਹੀ ਪਿਛਲੀ ਐਸ ਆਈ ਟੀ ਦੇ ਨੰਗੇ ਚਿੱਟੇ ਸਿਆਸੀਕਰਨ ਕਾਰਨ ਆਈ ਹੈ। ਸਰਦਾਰ ਬਾਦਲ ਨੇ ਪਿਛਲੀ ਐਸ ਆਈ ਟੀ ਦੇ ਨੰਗੇ ਚਿੱਟੇ ਸਿਆਸੀ ਵਤੀਰੇ ਦੀ ਨਿਖੇਧੀ ਕੀਤੀ ਜਿਸਕਾਰਨ ਸਾਰੀ ਜਾਂਚ ਪ੍ਰਕਿਰਿਆ ਹੀ ਢਹਿ ਢੇਰੀ ਹੋ ਗਈ।
ਉਹਨਾਂ ਨੇ ਪਿਛਲੀ ਐਸ ਆਈ ਟੀ ਵਿਚ ਸਾਰੇ ਸਥਾਪਿਤ ਨਿਯਮਾਂ ਤੇ ਤੌਰ ਤਰੀਕਿਆਂ ਨੂੰ ਛਿੱਕੇ ਟੰਗ ਕੇ ਇਕ ਅਫਸਰ ਨੇ ਆਪਣੇ ਆਪ ਹੀ ਸਾਰੀਆਂ ਤਾਕਤਾਂ ਹਥਿਆ ਲਈਆਂ ਤੇ ਐਸ ਆਈ ਟੀ ਦੇ ਚੇਅਰਮੈਨ ਸਮੇਤ ਹੋਰ ਮੈਂਬਰਾਂ ਦੀ ਭੂਮਿਕਾ ਵੀ ਆਪ ਹੀ ਅਪਣਾ ਲਈ ਤੇ ਬਾਕੀਆ ਨੂੰ ਬੇਕਾਰਕਰ ਦਿੱਤਾ ਤੇ ਇਹ ਜਾਂਚ ਪ੍ਰਕਿਰਿਆ ਦਾ ਹਿੱਸਾ ਵੀ ਨਹੀਂ ਰਹੇ।
ਸਾਬਕਾ ਮੁੱਖ ਮੰਤਰੀ ਨੇ ਉਹਨਾਂ ਰਿਪੋਰਟਾਂ ਦਾ ਹਵਾਲਾ ਦਿੱਤਾ ਜਿਸ ਵਿਚ ਕਿਹਾ ਗਿਆ ਸੀ ਕਿ ਪਿਛਲੀ ਐਸ ਆਈ ਟੀ ਦੀ ਰਿਪੋਰਟ ਸੱਤਾਧਾਰੀ ਪਾਰਟੀ ਦੇ ਅੱਧਾ ਦਰਜਨ ਮੈਂਬਰਾਂ ਨੇ ਤਿਆਰ ਕੀਤੀ ਸੀ ਤੇ ਇਸ ਰਿਪੋਰਟ ਦਾ ਅੱਜ ਤੱਕ ਕਿਸੇ ਨੇ ਖੰਡਨ ਨਹੀਂ ਕੀਤਾ।

I am in receipt of your summon No. 211/SIT, dated 9.6.2021 under section 160 Cr.P.C. requiring my presence in the investigations of FIR No. 192, Dated 14.10.2015 PS City Kotkapura and FIR No 129, Dated 7.8.2018 PS City Kotkapura on 16. 06.2021 at PSPCL Rest House, Phase 8, SAS Nagar (Mohali)
I was similarly asked to join an identical investigation by the now defunct SIT. The investigations by that SIT were quashed by the Hon’ble Punjab and Haryana High Court.
With regard to my appearance before the new SIT headed by you, I wish to submit as under:
Although the entire process of investigations into the said case stands brazenly compromised through blatant and unapologetic political interference and although it reeks too strongly of political vendetta to inspire any confidence about a fair process of law, yet I have repeatedly and categorically declared my intent and commitment to cooperating fully with the law, as I have complete faith in the judiciary.
Accordingly, I wish to inform you that I will cooperate fully and whole heartedly with the process of investigations by the fresh SIT. I also hope that this SIT, unlike the previous one, would respect the law of the land and conduct a fair investigation, withstanding the political interference from the ruling dispensation which is known to be brazen in subverting the law for their personal political gains.
The present SIT had been set up in the wake of the brazen politicization of the previous SIT. The overtly political conduct of one of its members had allegedly subverted the entire investigative process. With a callous and contemptuous disregard for all the established procedures and norms, the officer completely usurped and appropriated to himself the entire functioning and designated role of all the other members of the SIT, including it Chairman , and rendered them totally redundant.
In the process, all the other members of the SIT were reportedly not even a part of the investigative process. This was an unprecedented subversion of the legality, constitutionality and procedural propriety in the investigative process, turning the whole investigative exercise into an absurd political farce
Predictably, the Honourable High Court quashed the fictional narrative. There were reports, never contradicted, that the SIT findings had been authored jointly by half a dozen high profile members of the ruling party.
The Honourabe High Court made observations which are self speaking, before setting aside the investigation conducted by the previous SIT.
I hardly need emphasize that all through my long career as a servant of the people, I not only have been a law abiding citizen of the country but have always ensured that the law of the land is held in the highest esteem. As such, I am committed to cooperating with investigations underway.
However, my current state of health does not permit me to be available to join the investigation on the date specified by you. I have been advised complete bed rest of ten days by my physician; I am enclosing the Medical Certificate dated 8.6.2021.
As soon as my health gets better, I will be available to join the investigation as per law, at my current place of residence i.e. MLA Flat No 37, Sector 4, Chandigarh. Accordingly, I request you to reschedule the date for my appearance for the investigations.
I will look forward to hearing from you in this regard at the earliest.
