The Punjab and Haryana High Court on Monday ordered a Central Bureau of Investigation (CBI) probe into allegations contained in Enforcement Directorate (ED) communications to the Punjab DGP concerning alleged corruption and interference in government transfers, postings and tenders.
The court has directed the CBI to submit its report within two months. The order came on a public interest litigation filed by advocate Nikhil Saraf, who had sought an independent investigation after the Punjab Police did not register an FIR on the basis of the ED’s communications.
The ED had written to Punjab DGP Gaurav Yadav seeking registration of an FIR against Rajbir Singh Ghuman, an OSD to Chief Minister Bhagwant Mann, and others, including Nitin Gohal and Bir Devinder. The agency’s allegations relate to purported interference in official transfers and postings and government tender-related processes. The allegations have not been established by a court.
Saraf’s petition argued that the matter required a “fair and independent investigation” free from the influence of state police and vigilance agencies. He also sought examination of the alleged money trail and action against anyone found culpable.
The ED had earlier told the High Court that it had sent multiple communications to Punjab authorities in connection with the allegations and had sought registration of an FIR. Ghuman and Gohal have denied the allegations.
The case had also triggered political reactions in Punjab. The Shiromani Akali Dal had urged Governor Gulab Chand Kataria to seek a time-bound, court-monitored CBI investigation, while the BJP had questioned the absence of an FIR and demanded an independent probe.
The High Court’s latest direction now places the investigation with the CBI, which has been given two months to submit its findings.
