The Food Safety and Standards Authority of India (FSSAI) has issued a notice to Nestle India seeking scientific evidence to substantiate a claim that the whey protein in its Lactogen Pro 1 Powder is easy to digest.
The regulator said the claim, which appeared on the product’s packaging or advertising material, required scientific substantiation. The company has been directed to submit relevant documents and supporting evidence within the stipulated timeframe.
The action is part of a broader FSSAI crackdown on potentially misleading claims and non-compliant promotional practices involving food products, including infant feeding and nutritional products.
According to the regulator, notices have also been issued to food business operators over claims and promotions concerning products such as Nan Excella Pro Stage 1 and Complan.
FSSAI said food business operators must ensure that claims made on product labels, packaging and advertisements are supported by adequate scientific evidence and comply with applicable food safety laws and advertising regulations.
The notices require the companies concerned to explain why action should not be initiated against them under the Food Safety and Standards Act, 2006, and the rules and regulations framed under it.
The regulator has specified that the companies must respond within the prescribed period from the date the notices were issued.
The notice seeks substantiation of the digestibility claim; the information provided by FSSAI does not establish that the claim has been found false or that any penalty has been imposed on Nestle India.
