The Delhi High Court took strong cognizance while listening over half a dozen petitions of employees of Guru Harkrishan Public Schools (GHPS) running under the management of the Delhi Sikh Gurdwara Management Committee (DSGMC).
While giving details in this matter, Mr. Inder Mohan Singh, expert in Delhi Gurdwara Affairs said that in a bunch of cases pertaining to the non-payment of salary as per 6th and 7th CPC, withholding of 40% salary of employees and retiral benefits of employees of the GHPS schools, Justice V. Kameswar Rao of the Hon’ble Delhi High Court earlier issued Orders on August 8, 2021 to the DSGMC to pay an interim amount of Rs.2.5 lakh to every retired employee.
The Court also directed the DSGMC to file the financial accounts and bank details of the GHPS, School Society and the DSGMC and to file an affidavit giving time-schedule for payment of 40% arrears of 6th and 7th CPC by September 2, 2021.
Mr Inder Mohan Singh said that the DSGMC counsel again tried to seek adjournment to file the requisite documents till new management Committee took over consequent upon the recent Delhi Gurdwara Elections.
But, After hearing the argments, Justice Rao issued strict Orders to the DSGMC to file the required documents in the Court positively by Septemer 27, 2021 failing which all the pending petitions of GHPS will be converted into the Contempt of Court petitions and strict action will be taken accordingly.
Mr Inder Mohan Singh said that the Court has also asked a Counsel of the employees to file a comprehensive report within 2 weeks containing all cases of Contempt of Court, deviating from statements and disobeying the Orders of the Court so that suitable action be taken against the office-bearers of DSGMC.
The Hon’ble Court has also directed the DSGMC to apprise the Delhi Government’s Education Department immediately every time while making any payment to the employees of the GHPS. The next date of hearing in these matters has been fixed for 28th September, 2021.
