Chief Justice of India Surya Kant on Tuesday questioned a lawyer seeking an urgent hearing in a disproportionate assets case involving Leader of the Opposition in the Lok Sabha Rahul Gandhi, asking whether the move was intended to attract media attention.
The matter was mentioned before the CJI for early listing, with the lawyer citing Gandhi’s recent claim at an event that he was in touch with around 200 officials of the Enforcement Directorate (ED) and the Central Bureau of Investigation (CBI).
Taking exception to the grounds advanced for an urgent hearing, the Chief Justice remarked, “There is no head, no tail to this mentioning.”
He also asked the lawyer, “Have you spoken to any news channel for this?”
Following the exchange, the CJI orally instructed court staff to discontinue live streaming of mentioning proceedings in the future.
The development comes against the backdrop of an earlier Supreme Court order staying proceedings before the Allahabad High Court in the disproportionate assets matter and restraining the CBI and ED from submitting any report to that court.
The case stems from a complaint by Karnataka-based BJP worker S. Vignesh Shishir, who alleged that Gandhi possessed assets disproportionate to his known sources of income.
In August, the Supreme Court had asked the Allahabad High Court to defer proceedings and barred the central agencies from submitting reports in the matter. It had also clarified that investigative agencies could independently act on information about alleged disproportionate assets without requiring a court order.
Gandhi had approached the Supreme Court challenging the Allahabad High Court’s directions to the CBI and ED to verify the allegations. He also filed a separate transfer petition seeking to move the proceedings from the Allahabad High Court to the Delhi High Court.
The allegations remain subject to legal proceedings, and the case has not been established as proven wrongdoing.
