US-based lawyer Jim Walden has said the dismissal of criminal charges against Adani Group Chairman Gautam Adani and his nephew Sagar Adani highlights the difficulties faced by US authorities when attempting to prosecute conduct occurring outside the country and involving no direct impact on US citizens.
Speaking to IANS, Walden said the case began as a challenging prosecution but ultimately reflected the limits of US jurisdiction.
“It was an attempt by our federal government to reach across the waters and in some ways regulate and enforce activity occurring beyond its borders that didn’t impact US citizens,” he said.
Walden said such cases presented a difficult position for the US government, adding that the same outcome could eventually emerge for other defendants whose cases remain pending.
US District Judge Nicholas Garaufis dismissed with prejudice the criminal charges against Gautam Adani, Sagar Adani and Vneet Jaain after the US Justice Department abandoned the prosecution. The dismissed charges included securities fraud, wire fraud conspiracy and securities fraud conspiracy, meaning they cannot be brought again in their current form.
Asked about the broader legal implications, Walden said the judge was required to consider the prosecutor’s request, although the court had raised questions regarding some defendants and charges.
He said the case also demonstrated that courts operate within limited jurisdictions and that enforcement priorities can change when administrations change.
“Only lessons learned are when cases are brought that are at the fringes of enforcement, there is always a risk that the cases will go away if there’s a new administration,” Walden said.
He added that both Democrats and Republicans could draw a lesson from the developments, particularly when pursuing cases involving conduct at the limits of federal enforcement authority.
The US Justice Department’s decision to abandon the prosecution brought an end to the criminal case against the Adani Group officials in the United States.
