The Food Safety and Standards Authority of India (FSSAI) has directed immediate action against the sale of Nestlé Low Fat Dairy Whitener after a laboratory analysis found a sample collected from Bharat Hotels Ltd, which operates The Lalit, to be unsafe.
The regulator issued a notice to the hotel operator, directing it to stop the sale of the identified product pending further proceedings. FSSAI also said the hotel had been given an opportunity to challenge the findings and appeal against the Food Analyst’s report within the prescribed period under food safety laws.
Responding to the notice, Vivek Shukla, CEO of The Lalit Suri Hospitality Group, said the product was a packaged dairy whitener procured from Nestlé India. He said FSSAI had collected the sample from The Lalit New Delhi around three months ago and that the hotel discontinued its use and removed all packets from its operations after receiving communication from the regulator.
Shukla maintained that the regulatory compliance issue was between FSSAI and Nestlé India, adding that the hotel remained committed to food safety standards and applicable regulations.
Nestlé India, meanwhile, maintained that its Low Fat Dairy Whitener was safe for consumption and complied with regulatory requirements.
According to a report by NDTV Profit, the company said phosphorus is naturally present in milk and milk-based products, and argued that the laboratory analysis measured total phosphorus without distinguishing between naturally occurring phosphorus and phosphorus added as a food additive.
Nestlé India further stated that the product’s added phosphorus levels remained within prescribed limits under the Food Safety and Standards Regulations, including on an “as consumed” basis.
FSSAI has directed the hotel to prohibit the sale of the identified product while further proceedings are pending.
