Coming to know of the registration of five FIRs against kissan leaders and workers, Chandigarh based advocates namely Rajinder Singh Cheema, Manjit Singh Khaira, Joginder Singh Toor, Onkar Singh, Tarlok Singh Chauhan, Rajeev Godara, Harchand Singh Bath, Kulbir Singh Dhaliwal, Vipin Kumar , Matwinder Singh, Devinder Singh Mann, Satnam Preet Singh Chauhan and Satbir Walia assembled at Sec.33, Chandigarh on 28.06.2021 to discuss the issue minutely.
They obtained copies of FIRs and on thread bare perusal of the FIRs, they found that the allegations leveled therein, are vague, absurd and not only patently false but ridiculous.
In FIR No.118 of PS Sector 36, it is mentioned that “with dandas and lathis in their hand, came 1. Baljeet Singh, 2. Prem Singh (Bhangu) 3. Kaka Singh, 4. Suresh Chander 5. Balwinder Singh 6. Harmeet Singh leaders of the Kissan Unions, tried to proceed further by breaking the barricade and caused injuries to government officials by their lathis and dandas, caused damage to government property.”
Everybody who has seen the protest fully covered on regional and national channels have seen that leaders named here were empty handed, were not involved in breaking barriers nor causing any injury to any one. Mostly they were in their cars, leading the protest.
In FIR No.95 of Police Station, Sector 17, it is stated that “at about 3.00 PM, a crowd in the form of ‘Kafla’ lead by Jas Bajwa and Sonia Mann came, bajwa wagging open talwars, dandas and lathis. When asked not to proceed further, they scuffled with me (HC Ashok Kumar 386 CP) and dragged my uniform, as a result shoulders of my uniform got torn, buttons broken, name plate fell down etc.
These two named in the FIR were not in Chandigarh on that day nor part of protest march. Could They tear clothes of police officials by remote control.
In FIR No.117 PS Sector 36 allegations are not only vague and unfounded but absurd to the core, not making out an offence, alleging farmers used force, caused injuries to police officials and damaged the government property. The FIR is against unknown persons, on causing damage to unknown property by unknown farmers.
The farmers protest on 26th of June,2021, was peaceful. The farmers were empty handed. Only some of them carried flags of their respective unions. People saw the protest on TV screens or as standbys, who can believe that farmers came armed with lathis, dandas and kirpans.
The bare reading of the FIRs would show that the FIRs are not only vague, absured and patently false but ridiculous also. Similar absurd allegation are mentioned in other two FIR’s.
The lawyers present (named above) have formed a defence committee to protect the rights of farmers and defend them from false cases.
The Committee feels and requests the administration to withdraw the FIRs so as to save itself from public ridicule. Pressurizing the farmers by involving them in false cases will not help the administration.
