Leader of the opposition Mr. Harpal Singh Cheema either pretends to be too smart to fool the public or due to lack of knowledge, making paradoxical statements. His recent statement asking the Speaker of the Punjab Legislative Assembly Rana KP Singh to conduct the floor test of the Punjab Government to prove its majority; is not only absurd but it reflects the complete lack of basic knowledge of the Rules of Procedure and Conduct of Business in the Punjab Legislative Assembly.
He being an advocate and leader of the opposition should know that when the House stands prorogued by the Governor, the Speaker of the Assembly has no power under the statutes to ask the leader of the house to seek a vote of confidence or floor test. It is for the members of the house to give notice of no confidence motion under rule 58 of The Rules of Procedure and Conduct of Business in the Punjab Legislative Assembly.
They (Aap Members) were expected to give nothing of no-confidence to the Secretary Punjab Vidhan Sabha at least two hours before the sitting of the house, on September, under rule 58, when the previous session of the assembly was called under Article 173 (1) of the constitution but quite ironically at that point in time the Aam Aadmi party preferred to meet the Governor and submitted the memorandum to him for the dismissal of the Chief Minister, rather than adopting the right course on the floor of the House.
Now when the Speaker has no power to order the floor test, they are unwisely asking him to do so. Why the AAM AADMI party is in the habit of dialing the wrong number always, it does not augur well for a party to beat around the bush, which is claiming to form the next Government in Punjab.
I would advise the LoP Mr. Harpal Singh Cheema not to make lop-sided and absurd Statements which have no legal sanctity and political relevance. He is expected to be thorough and well versed with the statutes of the Governance and that of legislative business in the Punjab Assembly, before he makes decisive statements on important issues.
