SC Reserves Order on Punjab Minister Sanjeev Arora’s Plea for Private Hospital Treatment

The Supreme Court on Tuesday reserved its order on a plea filed by Punjab Cabinet Minister Sanjeev Arora, who is currently in judicial custody in a money laundering case, seeking medical treatment at either Fortis Hospital or Medanta Hospital in Gurugram instead of AIIMS, New Delhi.

A bench of Justices S.C. Sharma and N.K. Singh reserved the verdict after hearing arguments from both sides on Arora’s medical condition and his request to receive treatment at a private hospital while remaining in custody.

Appearing for Arora, senior advocate Mukul Rohatgi argued that although the AIIMS Medical Board had found him “clinically stable”, it had recommended coronary angiography for further evaluation. He contended that sending Arora back to jail without completing the required medical assessment would not be appropriate.

Rohatgi referred to Arora’s medical history, including diabetes, hypertension, renal transplant, heart failure, pulmonary embolism and reduced left ventricular ejection fraction, to argue that his condition required specialised medical care.

He submitted that Article 21 of the Constitution entitled Arora to receive treatment at a hospital of his choice even during judicial custody, adding that he was not seeking release from custody and security arrangements could be made at the hospital.

Opposing the plea, Additional Solicitor General S.V. Raju, appearing for the Enforcement Directorate (ED), said the AIIMS Medical Board had declared Arora clinically stable and assured the court that necessary treatment would be provided.

The Centre’s law officer said Arora would be taken for angiography and, if required, further medical facilities would be provided. He argued that a preference for private treatment did not grant any special privilege to an accused in custody.

The Supreme Court had earlier directed the AIIMS Director to constitute a Medical Board to examine Arora’s health condition after the ED raised no objection to such an evaluation. The court had also ordered his shifting to AIIMS for medical assessment and sought a report.

Arora’s regular bail plea was earlier rejected by the Special PMLA Court on June 15, following which he approached the Punjab and Haryana High Court.

The ED arrested Arora on May 9 under the Prevention of Money Laundering Act (PMLA) in connection with an alleged ₹100-crore GST fraud case related to mobile phone sales. He remains in judicial custody.

The probe agency has alleged links between the money laundering investigation and Hampton Sky Realty. Arora and the company have denied the allegations, claiming compliance with applicable laws and stating that the company was itself a victim of supplier-side fraud.
