SAD files complaint against Dir Gurdwara Elections Narinder Singh to Central Vigilance Commission for violating DSGMC Act

The Shiromani Akali Dal has filed a complaint against Narinder Singh Director Gurdwara Elections with Central Vigilance Commissioner (CVC) Suresh N. Patel and has demand action against him for intentionally violating provisions of the Delhi Gurdwara Management Committee (DSGMC) Act 1971 while conduction election of members of DSGMC by way of Co-option.

In his complaint the DSGMC President and National Spokesman of Akali Dal Mr. Manjinder Singh Sirsa apprised the CVC about provisions of the DSGMC act for election of Co-option of members which said that under Section 4 (b) of the Delhi Sikh Gurdwara Act, 1971 election of members by co-option process starts as under:-

Co-option of members – (1) At the meeting of the elected members, convened by the Director under section-14, the Director shall proceed for the co-option of-

(i) the Head Priests of the four Akal Takhat Sahibs mentioned in sub-clause

(ii) the nominee of the Shiromani Gurdwara Prabhandhak Committee, Amritsar.

(iii) member (s) by draw of lots out of the Presidents of the registered Singh Sabhas: and

(iv) member (s) to represent the Sikh Community of Delhi as required by sub-clause (ii), (iii), (i) and (iv) respectively of clause (b) of section 4.

Mr. Sirsa said that Narinder Singh is presently discharging his official functions as Director Gurdwara Elections in the most arbitrary, vindictive, malafide and biased and illegal manner against the interests of Sikh Community of Delhi and also against the interests of DSGMC. He said that when despite having issued the Notification dated 31.08.2021 for completing the process of election of Co-opted members he did not follow Section 4 (b) of the Delhi Sikh Gurdwara Act, 1971 which mandates that election of members by co-option process starts as under:-

Co-option of members – (1) At the meeting of the elected members, convened by the Director under section-14, the Director shall proceed for the co-option of-

(i) the Head Priests of the four Akal Takhat Sahibs mentioned in sub-clause (ii) of Clause

(b) of section 4:

(ii) the nominee of the Shiromani Gurdwara Prabhandhak Committee, Amritsar.

(iii) member (s) by draw of lots out of the Presidents of the registered Singh Sabhas: and

(iv) member (s) to represent the Sikh Community of Delhi.

As required by sub-clause (ii), (iii), (i) and (iv) respectively of clause (b) of section 4.

The above constitutional provision of law was abruptly ignored and violated by Narinder Singh who was the Returning Officer of the meeting of 46 elected members of DSGMC for further co-option of above nine members which was held on 09-09-2021 by ignoring the first 3 items of the provision and taking up the co-option of 2 members as per item No.4 in spite of the resistance from the majority of the members only to favour S. Paramjit Singh Sarna who was a candidate as per item No.4 and deferring the co-option of the first 3 items without fixing any fixed date for the purpose.

He said that item No.1 pertains to the co-option of 4 High Priests of our Takhat Sahibs including Sri Akal Takhat Sahib but RO Narinder Singh acted arbitrarily and vindictively under obvious and shameless visible influence of opposition party with vested interests and ignored the co-option of High Priests as per item No.1 and preferred the co-option of an individual S. Paramjit Singh Sarna as per item No.4.

This action of the RO is not only the violation of law but is also a sin. He said that it is clear that Narinder Singh with malafied intentions trying to stall the co-option of the 4 Head Priests of our Holy Takhats, nominee of SGPC and 2 Presidents of Registered Singh Sabhas for giving more time to opposition parties for entering into horse trading of winning candidates. He said that Shiromani Akali Dal has secured absolute majority in the General Elections held on 22.08.2021 and with respect to which results were declared on 25.08.2021.

He said that the complaint/representation is being given to CVC office, being the statutory authority under section 2(g)(g) of Delhi Sikh Gurdwara Act, 1971, to ensure that appropriate steps be taken for the early completion of entire election process including the process of co-option of 9 members and the process of election of the Executive Board of Delhi Sikh Gurdwara Management Committee for avoiding any horse trading.

He also requested CVC to take immediate action against Mr. Narinder Singh for his deliberate violation of section 4(b) on 9.9.2021 whereby he deliberately did not follow the sequence of election of co-opted members as given in section 4(b) of Delhi Sikh Gurdwara Act, 1971.

Further, it is very much clear that Mr. Narinder Singh is biased and not working as a Govt. employee but working on the instructions of the opposition groups for the reasons best known to him. He even tried to bribe (2 crores each) our two elected members S. Raminder Singh Sweeta and S. Atma Singh Lubana, police complaint regarding the same have been already filed by our elected members in concerned police stations.

He also told CVC that prior to this latest incident of biased working, he had issued the Notification dated 30.03.2021 for arbitrarily freezing our election symbol of Bucket which was ultimately stayed by Hon’ble High Court of Delhi vide order dated 31.03.2021 passed in W.P(C) No. 3825 of 2021. The said vicious attempt was made by him two days before the start of submission of Nomination papers for the elections for the posts of Members of DSGMC which were vindictive and biased acts continued against the Sikh community and against our Party.
