Partap Bajwa to bring Motion to censure conduct of Chief Minister Bhagwant Mann in Assembly

Partap Singh Bajwa, a senior Congress leader and Leader of Opposition in Punjab Vidhan Sabha has shot off a letter to Punjab Speaker Kultar Singh Sandhwan and sought to move a Substantive Motion under Rule 71 of the Rules of Procedure and Conduct of Business in Punjab Vidhan Sabha, censuring the conduct of Chief Minister Bhagwant Singh Mann for bringing in a Confidence Motion against the rules and advisory of the Governor of Punjab.

CONTENT OF of Bajwa’s letter to the Speaker

I am sending herewith a copy of Substantive Motion under Rule 71 of the Rules of Procedure and Conduct of Business in The Punjab Vidhan Sabha, censuring the conduct of the Shri Bhagwant Mann, Chief Minister, Punjab, and Leader of the House on 27th September, 2022, which is self-explanatory.

Since it is not possible to meet with the requirement of at least seven clear days’ notice under Rule 71, I beseech your indulgence for relaxation of the time limit under proviso to this rule.

CONTENT OF Censure Motion

SUBSTANTIVE/CENSURE MOTION
(Under Rule 71)

This House strongly condemns and censures the conduct of Mr. Bhagwant Mann, Chief Minister and Leader of the House, for surreptitiously moving a Vote of Confidence on 27th September, 2022, without quoting any Rule and in utter disregard for the specific advisory already issued by the Hon’ble Governor, Punjab, on 21st September, 2022. Pertinently, it was totally against the communication of the Business proposed to be listed before the House, as conveyed by the Government through Secretary, Punjab Vidhan Sabha, to the effect that the state government proposes to take up legislative/government business which inter alia includes burning issues of GST, stubble burning, power scenario etc. for consideration of the state legislative (sic, legislature).

Further, it was mentioned that “In addition, business on different issues per notices received from the members may also be taken up during the session as per the relevant provisions and rules of procedure and conduct of business in the Punjab Vidhan Sabha”, excluding any reference to the vote of confidence.

Furthermore, without any decision in the Business Advisory Committee, despite a pointed query to this effect by the undersigned regarding the Vote of Confidence disregarding the precedence of the business communicated to the Governor which formed the basis of his consent for the summoning of the Session, the Chief Minister, ironically moved the motion regarding Vote of Confidence thereby flouting all established parliamentary conventions, the rules and provisions in the Constitution.

Thus, the above conduct of the Chief Minister deserves a censure by the House for manipulating the consent of the Governor for summoning the session and contrarily bringing the Motion of Confidence in the House has betrayed the trust of the Governor, constitutional Head of the State, trampled the rights and privileges of the Members of Opposition and disrespected the people of Punjab by his conduct in the august House. He has, therefore, rendered himself liable for censure of his conduct unbecoming the Chief Minister and Leader of the House.

Accordingly, I beg to move –

That this House expresses its displeasure and censures the conduct of Mr. Bhagwant Mann, Chief Minister, Punjab.”
