Nawanshahr Session Court sentences 2 accused to life imprisonment

The district and sessions Judge, Shaheed Bhagat Singh Nagar, Kanwaljit Singh Bajwa has awarded two accused with lifeterm, yesterday, while pronouncing a quantum of sentence.

As per the details, the both accused Charanjit Singh (34) and Gurmukh Singh (29), both residents of Ranewal, were booked by Police Station, Sadar Nawanshahar in FIR dated 26.05.2020 under sections 302, 307, 325, 323, 427 read with section 34 of the IPC and Section 120-B of the IPC on the statement of Balihar Singh of the same Village.

The motive behind the occurrence was told that last year in the month of March, deceased Paramjit Singh and his accomplices were involved in a fight, regarding which they were booked for the offence under Section 326 of the IPC. Earlier also Gurmukh Singh is facing trial in murder case and had come on parole.

As per FIR, they were charged with the accusations of hitting Paramjit Singh (driving a two wheeler scooter) and Pritam Singh (driving a bike) by a jeep on May 25, 2020, intentionally. They were rushed to IVY hospital, Nawanshahr for treatment where Paramjit Singh succumbed to his injuries.

Concluding the trial on April 29, 2023, the District and Session Judge writes, “In totality of the circumstances, it is concluded that accused Gurmukh Singh son of Sohan Singh had already been serving a Life Sentence, having been convicted in case FIR no.81 dated 27.05.2014, under Sections 302, 307, 34 and 120-B of the Indian Penal Code, Police Station Rahon.

It is also established in the file that at the instance of this accused duly endorsed by accused Charanjit Singh, FIR was registered against deceased Paramjit Singh. The present accused were in search of an opportunity when they could eliminate their enemy and when released on parole on 15.04.2020 to 27.05.2020 for six weeks and again from 27.05.2020 to 08.07.2020 for further six weeks, he along with Charanjit Singh found an opportunity to settle their scores with deceased Paramjit Singh on the fateful day.”

He further adds, “As per witness of Assistant Superintendent, Central Jail, Ludhiana, accused Gurmukh Singh was to surrender back in the Central Jail, Ludhiana on 08.07.2020, but he did not return because of his apprehension on 11.06.2020 in case FIR no.39 dated 26.05.2020, under Section 302, 427, 34 and 120-B of the IPC, Police Station Sadar Nawanshahr, i.e. the present case. The Assistant Superintendent has also proved on record the attested copy of the record showing parole granted to Gurmukh Singh accused.

As such, there is ample evidence to conclude that on finding an opportunity, the accused in furtherance of their common intention, as per their modus operandi, similar to that of Sessions Case no.33 of 2014, chased their victim Paramjit Singh and hit him from behind with their jeep, with such a force that he died of the injuries.”

The judgement further reads, “In such view of the matter, this Court is of the considered view that the prosecution has successfully proved on record beyond any reasonable doubt that the accused have committed murder of deceased Paramjit Singh and also caused grievous injuries on the person of Pritam Singh with an intention to cause his murder, in order to prevent him from becoming a witness in the present case and hence accused Charanjit Singh is held guilty and convicted for the offence punishable under Sections 302, 307, 323, 325 and 427 of the Indian Penal Code, whereas, accused Gurmukh Singh is held guilty and convicted for the offence punishable under Sections 302 read with Section 34 IPC, 307 read with Section 34 IPC, 323 read with Section 34 IPC, 325 read with Section 34 IPC and Section 427 read with Section 34 IPC.”

Pronouncing the quantum of sentence on May 3, 2023, the district and session court awarded the accused Charanjit Singh with life imprisonment u/s 302, RI for 10 years u/s 307 with fine of Rs 10,000 separately in both, RI for Six months u/s 323 with a fine of Rs 500, RI for two years u/s 325 with a fine of Rs 5000 and RI for a month u/s 427 of IPC with a fine of Rs 500 while the co-accused Gurmukh Singh with life imprisonment u/s 302 read with 34 IPC and RI for 10 years u/s 307 read with 34 IPC with fine of Rs 10,000 separately in both sentences besides RI for Six months u/s 323 read with 34 IPC with a fine of Rs 500, RI for two years u/s 325 read with read with 34 IPC with a fine of Rs 5000 and RI for a month u/s 427 read with 34 IPC with a fine of Rs 500.
