Mohali Stamp Duty Scam: Administration trying to save culprits by ‘sacrificing’ Kanungo & Patwari: Bir Devinder Singh

Former Deputy Speaker, Punjab Legislative Assembly and Senior Vice President, Shiromani Akali Dal (Sanyukt), Mr. Bir Devinder Singh said that the recent statement of Deputy Commissioner Mohali, Sh. Girish Dayalan appeared in the print media regarding ‘multi-crore stamp duty scam, certainly hints as to how smartly the Deputy Commissioner has done a clumsy exercise to cover up this scam in a fraudulent manner.

Referring to the earlier statement given by the Mohali Deputy Commissioner regarding this scam, Sh. Bir Devinder Singh said, “Surprisingly in the previous media reports Sh. Girish Dayalan himself had admitted that Vikas Sharma, Tehsildar Mohali had not only illegally transferred 120-acre land in two villages namely Bairampur and Manak Majra in Mohali district from Emaar MGF to MGF Developers, in pursuance of a demerger of companies”.

He said that not only this, Vikas Sharma had also hastily approved the mutation of this developed land which even had earmarked plots without charging any stamp duty, which caused huge loss to the state treasury and in view of such serious illegalities the Deputy Commissioner Mr. Girish Dayalan has also cancelled the mutation of the land in question and sent the case to the Government to frame a new policy guidelines to deal with such cases.

Mr. Bir Devinder Singh said that now Deputy Commissioner Mohali has issued another statement in stark contrast to his earlier statement in which he is clearly trying to save Vikas Sharma, the local tehsildar of Mohali saying that there were some procedural lapse on the part of the office-Kanungo and concerned Patwari. If there were only procedural lapse then why the Deputy Commissioner, exercising his special powers has quashed all the mutation sanctioned by the Tehsildar” added Bir Devinder Singh.

Mr. Bir Devinder Singh said that surprisingly in his subsequent statement given to media, the Deputy Commissioner tried to cover the fault of the erring Tehsildar, Mr.Vikas Sharma under the carpet by putting the entire blame on Kanungo office.

“I would like to ask the Deputy Commissioner, Mohali and the Financial Commissioner Revenue whether the office -Kanungo and Patwari posted in Mohali tehsil were competent enough to interpret the Judicial order of National Company Law Tribunal (NCLT) and further were they able to interpret it carefully and understand its nuance in the right perspective or not? Questioned Bir Devinder Singh.

He said that if this kind of sensitively cumbersome work was to be handled only by Kanungo and Patwari, then what was the duty of the Tehsildar in this matter, especially when the file of the case was sent by SDM, Mohali Mr. Jagdeep Sehgal, to the Tehsildar, then why the SDM Mr. Jagdeep Sehgal was sleeping over the issue and didn’t carefully supervise the entire matter, asked Mr. Bir Devinder Singh

“Now it is incumbent upon the Deputy Commissioner, Mohali to clarify that as per the Judicial order of the NCLT, which were submitted by MGF developers along with their application to SDM Mohali, Sh. Jagdeep Sehgal, whether the stamp duty had to be levied or not? asked Bir Devinder Singh.
